I forskrift 11. mars 2011 nr. 265 om sanksjoner mot Libya gjøres følgende endringer:

Forskriftens tittel skal lyde:

Forskrift om sanksjoner og tiltak mot Libya

Ny § 2 skal lyde:

selge, levere, overføre, transportere eller eksportere, direkte eller indirekte, utstyr som kan brukes til intern undertrykkelse og som er oppført i vedlegg I, uansett om det har norsk opprinnelse eller ikke, til libyske personer, enheter eller organer eller til bruk i Libya, kjøpe, importere eller transportere slik utstyr fra Libya, uansett om det har libysk opprinnelse eller ikke, levere, direkte eller indirekte, teknisk bistand eller meglervirksomhet i tilknytning til slik utstyr til libyske personer, enheter eller organer eller for bruk i Libya, tilby, direkte eller indirekte, finansiering eller finansiell bistand i tilknytning til slik utstyr, herunder gavebistand, lån eller eksportkredittforsikring i forbindelse med salg, levering, overførsel eller eksport av slik utstyr, eller til levering av tilknyttet teknisk bistand, til libyske personer, enheter eller organer eller til bruk i Libya, forsettlig delta i aktiviteter som har til formål eller som følge å omgå forbudene omhandlet i litra a) til d).

Som unntak fra forbudet i første ledd, kan Utenriksdepartementet gi tillatelse til salg, levering, overføring, transport eller eksport av utstyr og tilknyttet teknisk bistand eller finansiering mv. omfattet av første ledd dersom det fastslås at utstyret utelukkende er beregnet til humanitære formål eller personlig beskyttelse.

Gjeldende § 2 blir ny § 3 og skal lyde:

Midler og andre finansielle aktiva eller økonomiske ressurser som befinner seg i Norge og som direkte eller indirekte tilhører eller kontrolleres av personer eller enheter nevnt i vedlegg II og vedlegg III eller som senere blir listeført av FNs Sikkerhetsråd eller Sanksjonskomiteen, 1 eller personer eller enheter som opptrer på vegne av disse eller etter deres anvisning, eller eies eller kontrolleres av disse, skal fryses. Den som fryser et formuesgode skal straks underrette Utenriksdepartementet 2 om dette.

Det er forbudt for enhver å stille midler, finansielle aktiva eller økonomiske ressurser til rådighet for personer eller enheter som er angitt i første ledd.

er nødvendige for å dekke grunnleggende kostnader, herunder betaling av matvarer, husleie eller pantelån knyttet til bolig, medisiner og medisinsk behandling, skatt, lovpliktige forsikringspremier og avgifter for offentlige tjenester, utelukkende er ment for betaling av rimelige honorarer og refusjon av utgifter i forbindelse med juridisk bistand, utelukkende er ment for betaling av avgifter eller tjenestegebyr for rutinemessig oppbevaring eller forvaltning av frosne midler eller økonomiske ressurser, er nødvendige for å dekke ekstraordinære utgifter, er nødvendige for innfrielse av en panteheftelse hvor det aktuelle formuesgodet var gjenstand for pantsettelse før fryspålegget trådte i kraft, og midlene ikke tilfaller personer eller enheter angitt i første ledd, eller er nødvendige for oppfyllelse av en dom, forutsatt at dommen ble avsagt før fryspålegget trådte i kraft og formuesgodet ikke tilfaller personer eller enheter angitt i første ledd.

Utenriksdepartementet kan dessuten gjøre unntak fra bestemmelsene i første og andre ledd og tillate at frosne midler og andre finansielle aktiva eller økonomiske ressurser, tilhørende eller kontrollert av listeførte i vedlegg III, frigjøres eller stilles til rådighet på vilkår som anses hensiktsmessige når departementet finner dette nødvendig for å oppfylle humanitære formål, som å levere eller lette leveringen av bistand, herunder legemidler og medisinsk utstyr, matvarer, forsyning av elektrisitet, humanitært personell og relatert bistand eller evakueringer fra Libya.

renter eller andre inntekter på disse kontoene, eller betalinger i henhold til kontrakter, avtaler eller forpliktelser som er inngått eller har oppstått forut for den dato da disse kontoene ble gjenstand for påbud om frysing i henhold til første ledd,

forutsatt at slike renter, andre inntekter og betalinger fortsatt omfattes av fryspåbudet i første ledd.

Påbudet om frys av midler mv. i første ledd forhindrer ikke en person eller enhet som ikke selv er listeført i vedlegg II og III, men hvor en listeført i disse vedleggene har en andel, fra fortsatt å drive lovlig virksomhet så lenge denne virksomheten ikke innebærer å stille midler, finansielle aktiva eller økonomiske ressurser til rådighet for den listeførte personen eller enheten.

Ny § 4 skal lyde:

fly over Libyas territorium, lande på Libyas territorium uansett formål, drive luftfartsvirksomhet til eller fra Libya.

dersom eneste formål er humanitært, som å levere eller lette leveringen av bistand, herunder legemidler og medisinsk utstyr, matvarer, humanitært personell og tilknyttet bistand, for evakueringer fra Libya, som er tillatt etter operativ paragraf 4 eller 8 i Sikkerhetsrådets resolusjon 1973 (2011), eller som Utenriksdepartementet, under utøvelse av den myndigheten som er gitt FNs medlemsstater etter operativ paragraf 8 i Sikkerhetsrådets resolusjon 1973 (2011), bedømmer som nødvendige til fordel for det libyske folk.

Forsettlig deltagelse i aktiviteter som har som formål eller følge å omgå forbudet i første ledd, er forbudt.

Gjeldende § 3 og § 4 blir nye § 5 og § 6.

Nytt vedlegg I skal lyde:

Fire-arms, ammunition and related accessories therefor, as follows: Firearms not controlled by ML 1 and ML 2 of the Common Military List of the European Union («Common Military List»); Ammunition specially designed for the firearms listed in item 1.1 and specially designed components therefor; Weapon-sights not controlled by the Common Military List. Bombs and grenades not controlled by the Common Military List. Vehicles as follows: Vehicles equipped with a water cannon, specially designed or modified for the purpose of riot control; Vehicles specially designed or modified to be electrified to repel borders; Vehicles specially designed or modified to remove barricades, including construction equipment with ballistic protection; Vehicles specially designed for the transport or transfer of prisoners and/or detainees; Vehicles specially designed to deploy mobile barriers; Components for the vehicles specified in items 3.1 to 3.5 specially designed for the purposes of riot control.
