Forskrift om endring i forskrift om særlige tiltak mot Syria

I forskrift 2. september 2011 nr. 902 om særlige tiltak mot Syria gjøres følgende endringer:

Ny § 5 skal lyde:

å selge, levere, overføre eller eksportere, direkte eller indirekte, utstyret eller teknologien oppført i vedlegg II til syriske personer, enheter eller organer eller til bruk i Syria, å yte, direkte eller indirekte, teknisk bistand eller meglertjenester i tilknytning til utstyret og teknologien angitt i vedlegg II, eller i tilknytning til levering, fremstilling, vedlikehold og bruk av varer oppført i vedlegg II, til syriske personer, enheter eller organer, å yte, direkte eller indirekte, finansiering eller finansiell bistand i tilknytning til utstyret og teknologien oppført i vedlegg II til syriske personer, enheter eller organer.

Forbudene ovenfor skal ikke hindre noen i å overholde de forpliktelser som følger av kontrakter som ble tildelt eller inngått før 18. april 2012, forutsatt at personen eller enheten underretter Utenriksdepartementet.

Ny § 6 skal lyde:

å yte lån eller kreditt til foretak i Syria som deltar i bygging av nye kraftverk for strømproduksjon i Syria, å erverve eller utvide sin andel i foretak i Syria som deltar i bygging av nye kraftverk for strømproduksjon i Syria, herunder erverv av slike foretak i sin helhet og erverv av aksjer eller kapitalandeler.

Ny § 7 skal lyde:

Det er forbudt å delta i bygging av nye kraftverk for strømproduksjon i Syria.

Det er forbudt å yte teknisk bistand eller finansiering eller finansiell bistand til bygging av nye kraftverk for strømproduksjon i Syria.

Forbudet i første og andre ledd gjelder ikke for avtaler eller kontrakter inngått før 18. april 2012.

Gjeldende § 5 blir ny § 8.

Gjeldende § 6 blir ny § 9.

Gjeldende § 7 blir ny § 10.

Gjeldende § 8 blir ny § 11 og skal lyde:

er nødvendige for å dekke grunnleggende behov til de navngitte personene i vedlegg I til denne forskrift, og familiemedlemmer som de forsørger, herunder betaling av matvarer, leie eller pantelån, medisiner og medisinsk behandling, skatt, forsikringspremier og avgifter for offentlige tjenester, utelukkende er ment for betaling av rimelige honorarer og refusjon av utgifter i forbindelse med juridisk bistand, utelukkende er ment for betaling av avgifter eller tjenestegebyr for rutinemessig oppbevaring eller forvaltning av frosne midler eller økonomiske ressurser, eller er nødvendige for å dekke ekstraordinære utgifter, er nødvendige for humanitære formål, slik som levering av eller bidrag til levering av bistand, herunder medisinsk utstyr, mat, humanitært personell og tilsvarende assistanse, eller evakueringer fra Syria. skal utbetales til eller fra en diplomatisk eller konsulær utenriksstasjon eller en internasjonal organisasjon med folkerettslig immunitet, dersom utbetalingen har til hensikt å tilgodese den diplomatiske eller konsulære utenriksstasjonens eller internasjonale organisasjonens offisielle formål.

en overføring fra eller gjennom Den syriske sentralbank av mottatte formuesgoder som er frosset etter datoen for dens listeføring, eller en overføring av formuesgoder til eller gjennom Den syriske sentralbank, der overføringen er knyttet til en betaling fra en person eller enhet som ikke er listeført i vedlegg I og som forfaller i tilknytning til en konkret kommersiell avtale, forutsatt at Utenriksdepartementet i den enkelte sak har konstatert at betalingen, hverken direkte eller indirekte, vil bli mottatt av noen annen person eller enhet listeført i vedlegg I eller en overføring foretatt fra eller gjennom Den syriske sentralbank av frosne formuesgoder for å tilføre likviditet til finansielle institusjoner i Norge for å finansiere handel, forutsatt at overføringen er blitt godkjent av Utenriksdepartementet.

Gjeldende § 9 blir ny § 12 og skal lyde:

formuesgodene er gjenstand for en tilbakeholdsrett etablert gjennom en rettslig prosess, ved forvaltningsvedtak eller ved voldgift før datoen da personen, enheten eller organet omhandlet i 10 § første ledd ble listeført, eller for en dom, et forvaltningsvedtak eller en voldgiftsdom avsagt før samme dato, formuesgodene utelukkende skal brukes til å innfri krav som er sikret gjennom en slik tilbakeholdsrett eller som er fastsatt ved en slik dom eller forvaltningsvedtak, formuesgodene ikke kommer de personer, enheter eller organer som er listeført til gode, og anerkjennelse av tilbakeholdsretten eller avgjørelsen ikke strider med grunnleggende rettsstatsprinsipper.

Gjeldende § 10 blir ny § 13 og skal lyde:

Forbudet i § 10 første ledd skal ikke hindre de listeførte personene eller enhetene fra å betale et forfalt pengekrav etter kontrakt som var inngått før fryspålegget tok til å gjelde, forutsatt at betaling ikke direkte eller indirekte mottas av en person eller enhet som nevnt i vedlegg I.

Godkjenning av utbetalinger i medhold av denne bestemmelsen vedtas av Utenriksdepartementet.

Gjeldende § 11 blir ny § 14 og skal lyde:

renter eller andre inntekter på disse kontoene, eller betalinger i henhold til kontrakter, avtaler eller forpliktelser som er inngått eller har oppstått forut for den dato da disse kontoene ble gjenstand for påbud om frysing i henhold til § 10 første ledd, forutsatt at slike renter, andre inntekter og betalinger fortsatt omfattes av § 10 første ledd.

Gjeldende § 12 blir ny § 15.

Ny § 16 skal lyde:

å selge eller kjøpe, direkte eller indirekte, statsobligasjoner eller statsgaranterte obligasjoner utstedt etter 18. april 2012 til eller fra følgende: staten Syria eller dens regjering samt dens offentlige organer, foretak og virksomheter, syriske kreditt- eller finansinstitusjoner, fysiske eller juridiske personer, enheter eller organer som handler på vegne av eller etter ordre fra en juridisk person, en enhet eller et organ nevnt i i) eller ii), juridiske personer, enheter eller organer som eies eller kontrolleres av en person, en enhet eller et organ nevnt i i), ii) eller iii), å yte meglertjenester i forbindelse med statsobligasjoner eller statsgaranterte obligasjoner utstedt etter 18. april 2012 til en person, en enhet eller et organ nevnt i bokstav a), å bistå en person, en enhet eller et organ nevnt i bokstav a) med henblikk på å utstede statsobligasjoner eller statsgaranterte obligasjoner, ved å yte meglertjenester, markedsføringstjenester eller andre tjenester i forbindelse med slike obligasjoner.

Ny § 17 skal lyde:

å åpne nye bankkonti i syriske kreditt- eller finansinstitusjoner, å opprette nye korrespondentbankforbindelser med syriske kreditt- eller finansinstitusjoner, å åpne nye representasjonskontorer eller opprette nye filialer eller datterselskaper i Syria, å opprette nye fellesforetak med syriske kreditt- eller finansinstitusjoner, å inngå avtaler for eller på vegne av syriske kreditt- eller finansinstitusjoner i forbindelse med åpning av representasjonskontorer eller opprettelse av filialer eller datterselskaper i Norge.

Ny § 18 skal lyde:

Det er forbudt å yte forsikrings- og gjenforsikringstjenester til Syrias regjering, syriske offentlige organer, foretak og virksomheter eller til personer eller enheter som handler på vegne av eller etter ordre fra dem, eller til enheter som eies eller kontrolleres av dem, herunder på ulovlig vis.

helse- eller reiseforsikring til fysiske personer, obligatoriske forsikringer eller ansvarsforsikring til syriske personer, enheter eller organer basert i Norge, forsikring eller gjenforsikring til eieren av skip, luftfartøyer eller kjøretøyer chartret av syriske personer, enheter eller organer når vedkommende person, enhet eller organ ikke står oppført i vedlegg I.

Ny § 19 skal lyde:

å selge, levere, overføre eller eksportere, direkte eller indirekte, utstyr eller programvare angitt i vedlegg III til syriske personer, enheter eller organer, å yte, direkte eller indirekte, teknisk bistand eller meglertjenester i tilknytning til utstyret og programvaren angitt i vedlegg III, eller i tilknytning til levering, fremstilling, vedlikehold og bruk av utstyret angitt i vedlegg III eller levering, installering, drift eller oppdatering av programvaren angitt i vedlegg III, til syriske personer, enheter eller organer, å yte, direkte eller indirekte, finansiering eller finansiell bistand i tilknytning til utstyret og programvaren angitt i vedlegg III, til syriske personer, enheter eller organer, å yte enhver form for tjeneste som gjelder overvåking eller avlytting av telekommunikasjon eller Internett-forbindelser til, eller til direkte eller indirekte fordel for, syriske personer, enheter eller organer.

Utenriksdepartementet kan gjøre unntak fra forbudet i første ledd.

Ny § 20 skal lyde:

å selge, levere, overføre eller eksportere, direkte eller indirekte, gull, diamanter og edle metaller angitt i vedlegg IV til Syrias regjering, dens offentlige organer, Den syriske sentralbank, syriske foretak og virksomheter eller til personer eller enheter som handler på vegne av eller etter ordre fra dem, eller til enheter som eies eller kontrolleres av dem, å kjøpe, importere eller transportere gull, diamanter og edle metaller angitt i vedlegg IV, fra Syrias regjering, dens offentlige organer, Den syriske sentralbank, syriske foretak og virksomheter eller personer eller enheter som handler på vegne av eller etter ordre fra dem, eller til enheter som eies eller kontrolleres av dem, å yte, direkte eller indirekte, teknisk bistand eller meglertjenester i tilknytning til produktene vist til i litra a og b til Syrias regjering, dens offentlige organer, Den syriske sentralbankforetak og syriske virksomheter eller personer eller enheter som handler på vegne av eller etter ordre fra dem, eller til enheter som eies eller kontrolleres av dem.

Gjeldende § 13 blir ny § 21.

Gjeldende § 14 blir ny § 22. Eksisterende vedlegg I skal erstattes med nytt vedlegg I som følger vedlagt. Nytt vedlegg II, III og IV følger vedlagt.

General Technology Note (GTN)

1. The «technology required» for the «development», «production» or «use» of prohibited goods remains under prohibition even when applicable to non-prohibited goods.

2. Prohibitions do not apply to that «technology» which is the minimum necessary for the installation, operation, maintenance (checking) and repair of those goods which are not prohibited or the export of which has been authorised in accordance with this Regulation.

3. Prohibitions on «technology» transfer do not apply to information «in the public domain», to «basic scientific research» or to the minimum necessary information for patent applications.

Exploration and production of crude oil and natural gas

1.A Equipment

1. Geophysical survey equipment, vehicles, vessels and aircraft specially designed or adapted to acquire data for oil and gas exploration and specially designed components therefor.

2. Sensors specially designed for downhole well operations in oil and gas wells, including sensors used for measurement whilst drilling and the associated equipment specially designed to acquire and store data from such sensors.

3. Drilling equipment designed to drill rock formations, specifically for the purpose of exploring for, or producing oil, gas and other naturally occurring, hydrocarbon materials.

Technical Notes: A «blowout preventer» is a device typically used at ground level (or if drilling underwater, at the seabed) during drilling to prevent the uncontrolled escape of oil and/or gas from the well. A «Christmas tree or production tree» is a device typically used to control flow of fluids from the well when it is complete and oil and/or gas production has started. For the purpose of this item, «API and ISO specifications» refers to the American Petroleum Institute specifications 6A, 16A, 17D and 11IW and/or the International Standards Organisation specifications 10423 and 13533 for blowout preventers, wellhead and Christmas trees for use on oil and/or gas wells.
