Forskrift om endring i forskrift om særlige tiltak mot Hviterussland

I forskrift 8. september 2006 nr. 1041 om særlige tiltak mot Hviterussland gjøres følgende endringer:

faglig bistand: enhver form for teknisk støtte i forbindelse med reparasjon, utvikling, framstilling, sammenstilling, prøving, vedlikehold eller enhver annen form for teknisk tjeneste, uansett om bistanden ytes i form av instruksjon, rådgivning, opplæring, overføring av driftskunnskaper eller ferdigheter eller konsulenttjenester; faglig bistand omfatter også muntlig bistand;

§ 3 første ledd skal lyde:

Midler og økonomiske ressurser som tilhører eller eies, besittes eller kontrolleres av de fysiske og juridiske personene, enhetene og organene som er oppført i vedlegg I, II og III til denne forskrift, skal fryses.

§ 3 tredje ledd skal lyde:

Det er forbudt for enhver å gjøre midler eller økonomiske ressurser direkte eller indirekte tilgjengelige for eller stille til rådighet for fysiske eller juridiske personer, enheter eller organer som er oppført i vedlegg I, II eller III til denne forskrift.

er nødvendige for å dekke grunnleggende behov til personene navngitt i vedlegg I, II eller III til denne forskrift, og familiemedlemmer som de forsørger, herunder betaling av matvarer, leie eller pantelån, medisiner og medisinsk behandling, skatt, forsikringspremier og avgifter for offentlige tjenester,

3 tredje ledd får ikke anvendelse på tilskudd til frosne kontoer i form av

§ 4 nytt tredje ledd skal lyde:

Hvor en fysisk eller juridisk person, enhet eller organ oppført i vedlegg I, II eller III til denne forskriften har en betalingsforpliktelse som forfaller i henhold til kontrakt eller avtale inngått før listeføringen av den fysiske eller juridiske personen, enheten eller organet, kan Utenriksdepartementet, som unntak fra § 3 første ledd, tillate at visse frosne midler eller økonomiske ressurser frigjøres på slike vilkår som anses hensiktsmessig, forutsatt at det er fastslått at betalingen ikke, direkte eller indirekte, er til fordel for en person, enhet eller et organ omfattet av forbudet i § 3 første ledd.

§ 4 nytt fjerde ledd skal lyde:

§ 3 tredje ledd skal ikke være til hinder for at de frosne kontoene godskrives av finansinstitusjoner som mottar midler som overføres av tredjemenn til kontoen til en person eller enhet oppført i listen, forutsatt at slike tilskudd også fryses. Finansinstitusjonen skal umiddelbart underrette Utenriksdepartementet om slike transaksjoner.

Ny § 5 skal lyde:

Det er forbudt å selge, levere, overføre eller eksportere, direkte eller indirekte, våpen og relatert materiell av enhver art, herunder ammunisjon, militære kjøretøy og militært utstyr, paramilitært utstyr og reservedeler til slikt materiell, til enhver fysisk eller juridisk person, enhet eller organ i, eller for bruk i, Hviterussland. Forbudet gjelder uavhengig av om utstyret har norsk opprinnelse eller ikke.

Ny § 6 skal lyde:

å yte, direkte eller indirekte, faglig bistand eller meglertjenester med tilknytning til utstyr som nevnt i § 5, eller med tilknytning til forsyning, fremstilling, vedlikehold eller bruk av slikt utstyr, til enhver fysisk eller juridisk person, enhet eller organ i, eller for bruk i, Hviterussland; å yte, direkte eller indirekte, finansiering eller finansieringsbistand, herunder særlig tilskudd, lån og eksportkredittforsikring, i forbindelse med salg, levering, overførsel eller eksport av utstyr omfattet av forbudet i § 5, eller i forbindelse med faglig bistand eller meglertjenester relatert til slikt utstyr, til enhver person, enhet eller organ i, eller for bruk i, Hviterussland; forsettlig å delta i aktiviteter hvis hensikt eller virkning er direkte eller indirekte å fremme transaksjonene nevnt i bokstav a og b.

Ny § 7 skal lyde:

Forbudene i § 5 og § 6 gjelder tilsvarende med hensyn til utstyr som kan bli brukt til intern undertrykking, og som fremkommer av vedlegg IV til denne forskriften.

Ny § 8 skal lyde:

salg, levering, overføring eller eksport av følgende utstyr: ikke-dødelig militært utstyr eller utstyr som kan bli brukt til intern undertrykking, som utelukkende er ment for humanitære formål eller beskyttende bruk eller for internasjonale programmer for institusjonsbygging eller for krisehåndteringsoperasjoner; eller ikke-stridende, pansrede kjøretøy som utelukkende er ment for beskyttende bruk av personell fra EU, EUs medlemsstater eller Norge i Hviterussland. faglig bistand eller meglertjenester samt finansiering eller finansiell bistand i tilknytning til utstyr som nevnt i bokstav a, såfremt de samme vilkår er oppfylt.

Tillatelser som nevnt i første ledd, må innhentes forut for gjennomføring av den aktivitet det søkes om tillatelse om.

Forbudene i § 5 til § 7 får ikke anvendelse på forsyninger av beskyttelsesbekledning, herunder skuddsikre vester og militærhjelmer, som er utført midlertidig til Hviterussland av FN-personell, personell fra Den europeiske union, dets medlemsstater eller den norske stat, eller representanter for media, humanitært hjelpepersonell, utviklingsarbeidere eller tilknyttet personell, og som utelukkende er ment til deres personlige bruk.

Gjeldende § 5 blir ny § 9.

Gjeldende § 6 blir ny § 10.

Vedlegg I skal lyde:

Personer ansvarlige for brudd på internasjonale valgstandarder i forbindelse med presidentvalget i Hviterussland 19. mars 2006 og for å ha slått ned på sivilt samfunn og demokratisk opposisjon, samt personer, enheter og organer tilknyttet disse (jf. vedlegg IV til EUs rådsbeslutning 2010/639/FUSP av 25. oktober 2010, jf. EUs rådsbeslutning 2011/174/FUSP av 21. mars 2011)
