Forskrift om endring i forskrift om særlige tiltak mot Syria

I forskrift 2. september 2011 nr. 902 om særlige tiltak mot Syria gjøres følgende endringer:

Del I gjeldende § 9 blir ny § 1a og skal lyde:

midler: finansielle aktiva og ytelser av enhver art, herunder, men ikke begrenset til kontanter, sjekker, pengefordringer, veksler, postanvisninger og andre betalingsinstrumenter, innskudd i finansinstitusjoner eller andre enheter, tilgodehavende på kontoer, gjeld og gjeldsforpliktelser, offentlig og privat omsatte verdipapirer og gjeldsinstrumenter, herunder aksjer og andre eierandeler, sertifikater som representerer verdipapirer, obligasjoner, egenveksler, kjøpsopsjoner, selskapsobligasjoner og derivatkontrakter; renter, utbytte eller andre inntekter eller verdier som påløper eller genereres av aktiva, kreditter, motregningsrettigheter, garantier, fullførelsesgarantier eller andre finansielle forpliktelser, rembursbrev, konossementer, løsørepantebrev, dokumentasjon på en interesse i midler eller finansielle ressurser, frysing av midler: forhindring av enhver flytting, overføring, endring, bruk av, tilgang til eller håndtering av midler på måter som ville resultere i en endring av midlenes volum, beløp, plassering, eierskap, besittelse, art, bestemmelse eller andre endringer som ville muliggjøre bruk av midlene, herunder porteføljeforvaltning; økonomiske ressurser: alle typer aktiva, materielle eller immaterielle, fast eiendom eller løsøre, som ikke er midler, men som kan brukes til å skaffe til veie midler, varer eller tjenester; Meglertjenester: forhandling eller styring av transaksjoner med henblikk på kjøp, salg eller levering av varer og teknologi fra et tredjeland til et annet tredjeland, eller salg eller kjøp av varer og teknologi som befinner seg i et tredjeland, med henblikk på overføring til et annet tredjeland.

Del II § 2 skal lyde:

Det er forbudt for norske rettssubjekter og for enhver som befinner seg på norsk territorium å selge eller levere, direkte eller indirekte, våpen og relatert materiell av enhver type, inkludert ammunisjon, militære kjøretøy og militært utstyr, paramilitært utstyr og reservedeler til slikt materiell, til enhver fysisk eller juridisk person, enhet eller ethvert organ i Syria. Forbudet gjelder uansett om varene har norsk opprinnelse eller ikke. Likeledes er det forbudt for norskregistrert skip eller luftfartøy å frakte varer, materiell, utstyr eller teknologi som nevnt til Syria.

Det er forbudt for norske rettssubjekter og for enhver som befinner seg på norsk territorium å yte tjenester i form av teknisk trening, meglervirksomhet, eller bistand, finansiering eller annen bistand i forbindelse med militære aktiviteter, herunder å tilby leiesoldater, eller anskaffelse, fremstilling, vedlikehold eller bruk av våpen, materiell og utstyr som nevnt i første ledd til enhver fysisk eller juridisk person, enhet eller ethvert organ i Syria.

Det er forbudt å delta, bevisst eller forsettlig, i aktiviteter som har til formål eller til følge å omgå forbudene i første og annet ledd.

forsyninger og teknisk assistanse til støtte for eller bruk av United Nations Disengagement Observer Force (UNDOF); levering av ikke-dødelig militært utstyr utelukkende beregnet til humanitære formål eller personlig beskyttelse eller for eller for internasjonale programmer for institusjonsbygging eller for krisehåndteringsoperasjoner; ikke-stridende, pansrede kjøretøy som utelukkende er ment for beskyttende bruk av personell fra EU, EUs medlemsstater eller Norge i Syria; midlertidig eksport av verneutstyr, som skuddsikre vester og hjelmer, til personlig bruk for personell som representerer FN, EU, media, humanitære organisasjoner eller utviklingsorganisasjoner; levering, direkte eller indirekte, av teknisk bistand eller meglervirksomhet i tilknytning til slik utstyr; levering, direkte eller indirekte, av finansiering eller finansiell bistand i tilknytning til slik utstyr.

Det gis ikke tillatelse til en handling som omhandlet i første og annet ledd, dersom det er skjellig grunn til å fastslå at handlingen kan være beregnet på eller bidra til intern undertrykking.

Forbudene i første og annet ledd får ikke anvendelse på forsyninger av beskyttelsesbekledning, herunder skuddsikre vester og militærhjelmer, som er utført midlertidig til Syria av FN-personell, personell fra Den europeiske union, dets medlemsstater eller den norske stat, eller representanter for media, humanitært hjelpepersonell, utviklingsarbeidere eller tilknyttet personell, og som utelukkende er ment til deres personlige bruk.

Del II § 2a skal lyde:

Forbudet i § 2 gjelder tilsvarende med hensyn til utstyr som kan bli brukt til intern undertrykking, og som fremkommer av vedlegg V.

Del II ny § 2b skal lyde:

Det kreves forhåndstillatelse for å selge, levere, overføre eller eksportere, direkte eller indirekte, varer og teknologi som er oppført i vedlegg VI uansett om de har norsk opprinnelse eller ikke, til syriske personer, enheter eller organer eller for bruk i Syria. Det samme gjelder for teknisk trening eller bistand, finansiering eller annen bistand i forbindelse med varer og teknologi som er oppført i vedlegg VI til syriske personer, enheter eller organer eller for bruk i Syria.

Forhåndstillatelse som nevnt i første ledd, skal ikke gis dersom det er skjellig grunn til å fastslå at handlingen kan være beregnet på eller bidra til intern undertrykking.

Del III gjeldende § 10 blir ny § 9 og skal lyde:

Midler og økonomiske ressurser som tilhører eller eies, besittes eller kontrolleres av fysiske eller juridiske personer, enheter eller organer oppført i vedlegg I til denne forskrift skal fryses.

Den som fryser midler eller økonomiske ressurser i samsvar med bestemmelsen i første ledd, skal umiddelbart underrette Utenriksdepartementet om dette.

Det er forbudt for enhver å gjøre midler eller økonomiske ressurser direkte eller indirekte tilgjengelige for eller stille til rådighet for fysiske eller juridiske personer, enheter eller organer oppført i vedlegg I til denne forskrift.

Forsettlig deltakelse i aktiviteter som har som formål eller virkning å omgå tiltakene nevnt i første og tredje ledd, er forbudt.

Fysiske eller juridiske personer eller enheter eller deres overordnede eller ansatte som i god tro og på det grunnlag at det er i samsvar med denne forskrift, fryser midler eller økonomiske ressurser eller nekter å gjøre midler eller økonomiske ressurser tilgjengelige, skal ikke på noen måte holdes ansvarlige, med mindre det kan bevises at midlene og de økonomiske ressursene ble fryst som følge av uaktsomhet.

Del III gjeldende § 11 blir ny § 10 og skal lyde:

er nødvendige for å dekke grunnleggende behov til de navngitte personene i vedlegg I til denne forskrift, og familiemedlemmer som de forsørger, herunder betaling av matvarer, leie eller pantelån, medisiner og medisinsk behandling, skatt, forsikringspremier og avgifter for offentlige tjenester, utelukkende er ment for betaling av rimelige honorarer og refusjon av utgifter i forbindelse med juridisk bistand, utelukkende er ment for betaling av avgifter eller tjenestegebyr for rutinemessig oppbevaring eller forvaltning av frosne midler eller økonomiske ressurser, eller er nødvendige for å dekke ekstraordinære utgifter, er nødvendige for humanitære formål, slik som levering av eller bidrag til levering av bistand, herunder medisinsk utstyr, mat, humanitært personell og tilsvarende assistanse, eller evakueringer fra Syria. skal utbetales til eller fra en diplomatisk eller konsulær utenriksstasjon eller en internasjonal organisasjon med folkerettslig immunitet, dersom utbetalingen har til hensikt å tilgodese den diplomatiske eller konsulære utenriksstasjonens eller internasjonale organisasjonens offisielle formål.

Del III ny § 11 skal lyde:

for transaksjoner foretatt av eller gjennom den syriske sentralbanken vedrørende midler eller økonomiske ressurser mottatt og frosset etter datoen for dens listeføring når det er fastslått at transaksjonen er relatert til en betaling som forfaller i tilknytning til en konkret kommersiell avtale, eller for transaksjoner vedrørende midler eller økonomiske ressurser til eller gjennom den syriske sentralbanken når det er fastslått at transaksjonen er relatert til en betaling som forfaller i tilknytning til en konkret kommersiell avtale, eller for transaksjoner vedrørende midler eller økonomiske ressurser nødvendige for å gi finans- eller kredittinstitusjoner likviditet til å finansiere handel

forutsatt at Utenriksdepartementet i den enkelte sak har konstatert at betalingen, hverken direkte eller indirekte, vil bli mottatt av noen annen person eller enhet listeført i vedlegg I, og betalingen ikke vil bidra til aktiviteter som er forbudt i henhold til denne forskriften.

Del III § 12 skal lyde:

midlene eller de de økonomiske ressursene er gjenstand for en tilbakeholdsrett etablert gjennom en rettslig prosess, ved forvaltningsvedtak eller ved voldgift før datoen da personen, enheten eller organet omhandlet i 9 § første ledd ble listeført, eller for en dom, et forvaltningsvedtak eller en voldgiftsdom avsagt før samme dato, midlene eller de de økonomiske ressursene utelukkende skal brukes til å innfri krav som er sikret gjennom en slik tilbakeholdsrett eller som er fastsatt ved en slik dom eller forvaltningsvedtak, midlene eller de de økonomiske ressursene ikke kommer de personer, enheter eller organer som er listeført til gode, og anerkjennelse av tilbakeholdsretten eller avgjørelsen ikke strider med grunnleggende rettsstatsprinsipper.

Del III § 13 skal lyde:

når en person eller enhet som er oppført i vedlegg I, skal betale forfalte beløp i henhold til en kontrakt, avtale eller forpliktelse som vedkommende person eller enhet har inngått eller pådratt seg før datoen for listeføringen, forutsatt at Utenriksdepartementet i den enkelte sak har konstatert at betalingen, hverken direkte eller indirekte, vil bli mottatt av noen person eller enhet listeført i vedlegg I eller; for transaksjoner foretatt av eller gjennom en betalingsinstitusjon oppført i vedlegg I, når transaksjonen er relatert til en betaling fra en person eller enhet som ikke er oppført i vedlegg I, og har til formål å bistå syriske statsborgere med å ta utdanning eller delta i andre former for opplæringstilbud i Norge, forutsatt at Utenriksdepartementet i den enkelte sak har konstatert at betalingen, hverken direkte eller indirekte, vil bli mottatt av noen person eller enhet listeført i vedlegg I.

Del III § 14 skal lyde:

renter eller andre inntekter på disse kontoene, eller betalinger i henhold til kontrakter, avtaler eller forpliktelser som er inngått eller har oppstått forut for den dato da disse kontoene ble gjenstand for påbud om frysing i henhold til § 9 første ledd, forutsatt at slike renter, andre inntekter og betalinger fortsatt omfattes av § 9 første ledd.

Del III ny § 21 skal lyde:

Det er forbudt for norske rettssubjekter og for enhver som befinner seg på norsk territorium å selge, levere, overføre eller transportere luksusvarer oppført i vedlegg VII til Syria.

Det er forbudt å delta, bevisst eller forsettlig, i aktiviteter som har til formål eller til følge å omgå forbudet i første ledd.

Unntatt fra forbudene i første ledd er reisebagasje som inneholder ikke-kommersielle varer til personlig bruk.

Del IV gjeldende § 21 blir ny § 22.

Del IV gjeldende § 22 blir ny § 23.
