Forskrift om endring i forskrift om særlige tiltak mot Syria

I forskrift 2. september 2011 nr. 902 om særlige tiltak mot Syria gjøres følgende endringer:

§ 1 til § 23 med tilhørende vedlegg oppheves.

Ny § 1 skal lyde:

på norsk territorium, inkludert norsk luftrom om bord på alle luftfartøy eller fartøy under norsk jurisdiksjon overfor alle norske statsborgere uansett hvor de befinner seg overfor alle juridiske personer, enheter og organer som er etablert eller stiftet i henhold til norsk lovgivning overfor alle juridiske personer, enheter og organer med hensyn til forretningsvirksomhet de driver helt eller delvis i Norge.

Ny § 2 skal lyde:

EUs vedlagte forordning (EU) nr. 36/2012 om visse spesifikke restriktive tiltak mot visse personer og enheter i lys av situasjonen i Syria (som endret av forordninger (EU) nr. 55/2012, (EU) nr. 168/2012, (EU) nr. 266/2012, (EU) nr. 509/2012, (EU) nr. 544/2012, (EU) nr. 545/2012, (EU) nr. 673/2012, (EU) nr. 867/2012, (EU) nr. 944/2012, (EU) nr. 1117/2012, (EU) nr. 325/2013, (EU) nr. 363/2013, (EU) nr. 517/2013, (EU) nr. 697/2013) gjelder som forskrift med de tilpasninger som følger av denne bestemmelsen. «Medlemsstat», «EU» og «Den europeiske union» skal forstås som «Norge». Unntak gjelder for artikkel 3, 18 og 19 hvor EU skal forstås som også å omfatte Norge. Henvisningene til «EUs felles liste over militært utstyr» skal forstås som «Utenriksdepartementets vareliste I» (våpen, ammunisjon, annet militært materiell og tilhørende teknologi) i forskrift 19. juni 2013 nr. 718 om eksport av forsvarsmateriell, flerbruksvarer, teknologi og tjenester. Henvisningene til medlemsstatenes kompetente myndigheter, i enkelte tilfelle med referanser til vedlegg III, skal forstås som «Utenriksdepartementet». Henvisningene til virkeområdet i artikkel 35 skal forstås som «forskriftens virkeområde slik dette er fastlagt i § 1». Ingen av forordningens bestemmelser om informasjonsutveksling mellom medlemsstater og Kommisjonen kommer til anvendelse. Videre er også følgende artikler EU-interne og kommer ikke til anvendelse: 2, 23, 28, 30–37. Tilsvarende gjelder forordningens vedlegg III.

Ny § 3 skal lyde:

Overtredelse av bestemmelser gitt i denne forskriften er straffbart i henhold til lov 27. april 2001 nr. 14 om iverksetjing av internasjonale, ikkje-militære tiltak i form av avbrot eller avgrensing av økonomisk eller anna samkvem med tredjestatar eller rørsler § 3.

Ny § 4 skal lyde:

Utenriksdepartementet kan dispensere fra forskriften på grunnlag av vedlagte forordnings dispensasjonsbestemmelser. Utenriksdepartementet kan også i særskilte tilfeller dispensere fra forskriften dersom den får en klart utilsiktet virkning, og forutsatt at det ikke strider mot Norges folkerettslige forpliktelser eller hensynene bak tiltakene mot Syria.

Ny § 5 skal lyde:

Utenriksdepartementet gis fullmakt til å endre, suspendere eller oppheve forskriften.

Ny § 6 skal lyde:

Denne forskrift trer i kraft straks.

Kapittel I Definisjoner

«filial av en finans- eller kredittinstitusjon»: et forretningssted som utgjør en juridisk avhengig del av en finans- eller kredittinstitusjon, og som direkte utfører alle eller noen av transaksjonene som hører inn under finans- eller kredittinstitusjoners forretningsvirksomhet, «formidlingstjenester»: forhandling eller organisering av transaksjoner med henblikk på kjøp, salg eller levering av varer og teknologi fra et tredjeland til et annet tredjeland, eller salg eller kjøp av varer og teknologi som befinner seg i tredjeland med henblikk på overføring til et annet tredjeland. «kontrakt eller transaksjon»: enhver transaksjon, uansett form og uansett hvilke lover som kommer til anvendelse, bestående av en eller flere kontrakter eller lignende forpliktelser som er inngått mellom samme eller forskjellige parter; for dette formål omfatter uttrykket «kontrakt» obligasjoner, garantier og motgarantier, spesielt finansielle garantier og motgarantier, og enhver kreditt, enten den er juridisk uavhengig av kontraktsforholdet eller ikke, samt enhver tilknyttet bestemmelse som oppstår i henhold til eller i forbindelse med transaksjonen, «kredittinstitusjon»: en kredittinstitusjon som definert i artikkel 4 nr. 1 i europaparlaments- og rådsdirektiv 2006/48/EF av 14. juni 2006 om adgang til å starte og utøve virksomhet som kredittinstitusjon, 1 herunder filialer innenfor eller utenfor EU, «råolje og oljeprodukter»: produktene oppført i vedlegg IV, «formuesgoder»: alle typer aktiva, materielle eller immaterielle, fast eiendom eller løsøre, som ikke er penger, men som kan benyttes til å skaffe penger, varer eller tjenester, «finansinstitusjon»: et foretak som ikke er en kredittinstitusjon, og som utfører en eller flere av transaksjonene nevnt i nr. 2 til 12 og nr. 14 og 15 i vedlegg I til direktiv 2006/48/EF, herunder virksomhet som vekslekontor, et forsikringsselskap som har fått tillatelse i henhold til europaparlaments- og rådsdirektiv 2002/83/EF av 5. november 2002 om livsforsikring, 2 i den grad det utøver virksomhet som dekkes av dette direktivet, et verdipapirforetak som definert i artikkel 4 punkt 1 nr. 1 i europaparlaments- og rådsdirektiv 2004/39/EF av 21. april 2004 om markeder for finansielle instrumenter, 3 et foretak for kollektiv investering som markedsfører sine enheter eller andeler, eller en forsikringsformidler som definert i artikkel 2 nr. 5 i europaparlaments- og rådsdirektiv 2002/92/EF av 9. desember 2002 om forsikringsformidling, 4 med unntak av formidlerne nevnt i artikkel 2 nr. 7 i nevnte direktiv, når de utøver virksomhet med hensyn til livsforsikring og andre investeringsrelaterte tjenester,

«frysing av formuesgoder»: å forhindre at formuesgoder på noen måte benyttes til å skaffe penger, varer eller tjenester, herunder, men ikke begrenset til å selge, leie ut eller pantsette dem, «frysing av penger»: å forhindre flytting, overføring, endring eller bruk av, tilgang til eller håndtering av penger på noen måte som kan medføre endringer i volum, mengde, plassering, eierskap, besittelse, art eller formål eller andre endringer som kan gjøre det mulig å bruke pengene, herunder porteføljeforvaltning, «penger»: finansielle aktiva og fordeler av enhver art, herunder, men ikke begrenset til kontante pengebeløp, sjekker, fordringer, veksler, anvisninger og andre betalingsinstrumenter, innestående hos finansinstitusjoner eller hos andre virksomheter, saldoer på konti, tilgodehavende og tilgodehavendebevis, børsnoterte og unoterte finansielle instrumenter og gjeldsinstrumenter, herunder aksjer og andre eierandeler, verdipapirsertifikater, obligasjoner, gjeldsbrev, kjøps- eller tegningsretter, usikrede verdipapirer og derivatkontrakter, renter, utbytte og andre inntekter eller verdier påløpt eller generert av aktiva, kreditter, motregningsretter, garantier, oppfyllelsesgarantier eller andre finansielle forpliktelser, remburser, konnossementer og pantebrev, og; dokumenter som viser eierandeler i penger eller finansielle ressurser, «varer»: produkter, materialer og utstyr, «forsikring»: et tilsagn om eller en forpliktelse for en eller flere fysiske eller juridiske personer, mot betaling og i tilfelle forsikringsbegivenheten inntrer, å yte erstatning eller en fordel som presisert i tilsagnet eller forpliktelsen til en eller flere andre personer, «gjenforsikring»: den form for virksomhet som består i å overta risikoer som overdras av et forsikringsselskap eller av et annet gjenforsikringsselskap, eller i tilfellet assurandørsammenslutningen Lloyds, den form for virksomhet som består i å overta risikoer som overdras av et medlem av Lloyds, av et forsikringsselskap eller et gjenforsikringsselskap som ikke er assurandørsammenslutningen Lloyds, «syrisk kreditt- eller finansinstitusjon»: alle kreditt- eller finansinstitusjoner hjemmehørende i Syria, herunder Syrias sentralbank, alle filialer eller datterselskaper som faller inn under virkeområdet til artikkel 35, av en kreditt- eller finansinstitusjon hjemmehørende i Syria, alle filialer eller datterselskaper som ikke faller inn under virkeområdet til artikkel 35, av en kreditt- eller finansinstitusjon hjemmehørende i Syria, alle kreditt- eller finansinstitusjoner som ikke er hjemmehørende i Syria, men som kontrolleres av en eller flere personer hjemmehørende i Syria, «syrisk person, enhet eller organ»: staten Syria eller offentlige myndigheter i landet, enhver fysisk person i eller med bopel i Syria, enhver juridisk person, ethvert selskap eller ethvert organ som er registrert som hjemmehørende i Syria, enhver juridisk person, enhver enhet eller ethvert organ, i eller utenfor Syria, som er eid eller direkte eller indirekte kontrollert av en eller flere av de ovennevnte personer eller organer, «faglig bistand»: enhver form for faglig støtte i forbindelse med reparasjon, utvikling, produksjon, samling, prøving, vedlikehold eller enhver annen form for faglig tjeneste, uansett om bistanden ytes i form av instruksjon, rådgivning, opplæring, overføring av driftskunnskaper eller ferdigheter eller konsulenttjenester; faglig bistand omfatter også muntlig bistand, «EUs territorium»: de av medlemsstatenes territorier der traktaten om Den europeiske unions virkemåte om kommer til anvendelse, på de vilkår som er fastsatt i traktaten, herunder deres luftrom. «EUs tollområde»: området definert i artikkel 3 i rådsforordning (EØF) nr. 2913/92 av 12. oktober 1992 om innføring av Fellesskapets tollkodeks. 5

Kapittel II Eksport- og importrestriksjoner

1. En medlemsstat kan forby eller kreve at det gis tillatelse til eksport, salg, levering eller overføring av utstyr som kan brukes til intern undertrykking, ut over det som er oppført i vedlegg IA eller vedlegg IX, uavhengig av om det har sin opprinnelse i Den europeiske union eller ikke, til personer, enheter eller organer i Syria eller til bruk i Syria.

2. En medlemsstat kan forby eller kreve at det gis tillatelse til levering av faglig bistand, finansiering og finansiell bistand i tilknytning til utstyret nevnt i nr. 1, til personer, enheter eller organer i Syria eller til bruk i Syria.

å selge, levere, overføre eller eksportere, direkte eller indirekte, utstyr, varer eller teknologi som kan brukes til intern undertrykking, eller til produksjon og vedlikehold av produkter som kan brukes til intern undertrykking, og som er oppført i vedlegg IA, uavhengig av om det har sin opprinnelse i Den europeiske union eller ikke, til personer, enheter eller organer i Syria eller til bruk i Syria, forsettlig å delta i aktiviteter som har som formål eller følge å omgå forbudene nevnt i bokstav a).

2. Som unntak fra bestemmelsene i nr. 1 kan de kompetente myndigheter i medlemsstatene, som angitt på nettsidene oppført i vedlegg III, gi tillatelse, på de vilkår de finner hensiktsmessige, til at det gjennomføres en transaksjon som gjelder utstyr, varer eller teknologi som er oppført i vedlegg IA, på betingelse av at utstyret, varene eller teknologien er ment for matvarer, landbruksformål, medisinske eller andre humanitære formål eller på FN-personell eller personell fra EU eller medlemsstatene.

1. Det skal kreves forhåndstillatelse til å selge, levere, overføre eller eksportere, direkte eller indirekte, utstyr, varer eller teknologi som kan brukes til intern undertrykking, eller til produksjon og vedlikehold av produkter som kan brukes til intern undertrykking, og som er oppført i vedlegg IX, uavhengig av om det har sin opprinnelse i Den europeiske union eller ikke, til personer, enheter eller organer i Syria eller til bruk i Syria,

2. Medlemsstatenes kompetente myndigheter, som angitt på nettsidene oppført i vedlegg III, skal ikke gi tillatelse til salg, levering, overføring eller eksport av utstyret, varene eller teknologien oppført i vedlegg IX dersom det er skjellig grunn til å fastslå at utstyret, varene eller teknologien som salget, leveringen, overføringen eller eksporten gjelder, brukes eller kan brukes til intern undertrykking eller til produksjon og vedlikehold av produkter som kan brukes til intern undertrykking.

3. Tillatelsen skal gis av de kompetente myndigheter i medlemsstaten der eksportøren er etablert, og skal være i samsvar med de detaljerte reglene fastsatt i artikkel 11 i rådsforordning (EF) nr. 428/2009 av 5. mai 2009 om en fellesskapsordning for kontroll med eksport, overføring, formidling og transitt av flerbruksvarer. 1 Tillatelsen skal gjelde i hele Den europeiske union.

Personen eller enheten som gir opplysningene, skal også legge fram eventuelle tillatelser som kreves i denne forordning.

2. Utstyr, varer og teknologi som det er forbudt å levere, selge, overføre eller eksportere i henhold til artikkel 2a i denne forordning, kan, i samsvar med nasjonal lovgivning eller en beslutning fra en kompetent myndighet, beslaglegges og avhendes for den persons eller enhets regning som er nevnt i nr. 1, eller, dersom det ikke er mulig å få disse kostnadene dekket av denne personen eller enheten, kan kostnadene i samsvar med nasjonal lovgivning kreves dekket av enhver person eller enhet som er ansvarlig for transport av varene eller utstyret i forsøket på ulovlig levering, salg, overføring eller eksport.

å yte, direkte eller indirekte, faglig bistand og formidlingstjenester knyttet til utstyr, varer eller teknologi som kan brukes til intern undertrykking, eller til produksjon og vedlikehold av produkter som kan brukes til intern undertrykking, og som er oppført i vedlegg IA, til personer, enheter eller organer i Syria eller til bruk i Syria, å yte, direkte eller indirekte, finansiering eller finansiell bistand knyttet til varer og teknologi oppført i vedlegg IA, herunder særlig tilskudd, lån og eksportkredittforsikring samt forsikring og gjenforsikring, i forbindelse med salg, levering, overføring eller eksport av slike produkter eller ved levering av tilknyttet faglig bistand til personer, enheter eller organer i Syria eller til bruk i Syria, forsettlig å delta i aktiviteter som har som formål eller følge å omgå forbudene nevnt i bokstav a) og b) ovenfor.

Medlemsstaten skal informere de andre medlemsstatene og Kommisjonen innen fire uker om tillatelser som er gitt i henhold til første ledd.

faglig bistand og formidlingstjenester knyttet til utstyr, varer eller teknologi oppført i vedlegg IX, og i forbindelse med levering, produksjon, vedlikehold og bruk av utstyret, varene og produktene, direkte eller indirekte, til personer, enheter eller organer i Syria eller til bruk i Syria, finansiering eller finansiell bistand knyttet til varer og teknologi nevnt i vedlegg IX, herunder særlig tilskudd, lån og eksportkredittforsikring samt forsikring og gjenforsikring, i forbindelse med salg, levering, overføring eller eksport av slike produkter og slik teknologi eller ved levering av tilknyttet faglig bistand til personer, enheter eller organer i Syria eller til bruk i Syria.

De kompetente myndigheter skal ikke gi tillatelse til transaksjonene nevnt i første ledd dersom det er skjellig grunn til å fastslå at disse transaksjonene er eller kan være ment å bidra til intern undertrykking eller til produksjon og vedlikehold av produkter som kan brukes til intern undertrykking.

å yte, direkte eller indirekte, finansiering eller finansiell bistand knyttet til varene og teknologien oppført i EUs felles liste over forsvarsutstyr, herunder særlig finansielle derivater, samt forsikring og gjenforsikring og formidlingstjenester som gjelder forsikring og gjenforsikring for kjøp, import eller transport av slike artikler dersom de har sitt opphav i Syria eller eksporteres fra Syria til et annet land, forsettlig å delta i aktiviteter som har som formål eller følge å omgå forbudene nevnt i bokstav a).

1. Det er forbudt å selge, levere, overføre eller eksportere, direkte eller indirekte, utstyr, teknologi eller programvare som er oppført i vedlegg V, uavhengig av om det har sin opprinnelse i Den europeiske union eller ikke, til personer, enheter eller organer i Syria eller til bruk i Syria, med mindre den relevante medlemsstatens kompetente myndigheter, som angitt på nettsidene oppført i vedlegg III, har gitt forhåndstillatelse til dette.

2. Medlemsstatenes kompetente myndigheter, som angitt på nettsidene oppført i vedlegg III, skal ikke gi tillatelse i henhold til nr. 1 dersom det er skjellig grunn til å fastslå at utstyret, teknologien eller programvaren ville bli brukt av Syrias regjering eller på dens vegne til overvåking eller avlytting av telekommunikasjoner eller Internett-forbindelser i Syria.

3. Vedlegg V inneholder en liste over utstyr, teknologi eller programvare som kan brukes til overvåking eller avlytting av Internett-forbindelser eller telekommunikasjoner.

4. Medlemsstaten skal underrette de øvrige medlemsstatene og Kommisjonen om alle tillatelser som gis i henhold til denne artikkel, senest fire uker etter at tillatelsen er gitt.

å yte, direkte eller indirekte, faglig bistand og formidlingstjenester i tilknytning til utstyr, teknologi og programvare som er oppført i vedlegg V, eller i tilknytning til levering, produksjon, vedlikehold og bruk av utstyr og teknologi som er oppført i vedlegg V, eller til levering, installering, drift eller oppdatering av programvare som er oppført i vedlegg V, til personer, enheter eller organer i Syria eller til bruk i Syria, å yte, direkte eller indirekte, finansiering eller finansiell bistand i tilknytning til utstyr, teknologi og programvare som er oppført i vedlegg V, til personer, enheter eller organer i Syria eller til bruk i Syria, å yte enhver form for tjeneste som gjelder overvåking eller avlytting av telekommunikasjoner eller Internett-forbindelser, til eller til direkte eller indirekte fordel for staten Syria, den syriske regjeringen, dens offentlige organer, foretak og etater eller til personer eller enheter som handler på deres vegne eller deres instruks, og forsettlig å delta i aktiviteter som har som formål eller følge å omgå forbudene nevnt i bokstav a), b) eller c) ovenfor,

med mindre den relevante medlemsstatens kompetente myndigheter, som angitt på nettsidene oppført i vedlegg III, har gitt forhåndstillatelse på det grunnlag som er fastsatt i artikkel 4 nr. 2.

2. Med «overvåking eller avlytting av telekommunikasjoner eller Internett-forbindelser» i artikkel 1 bokstav c) menes tjenester som, særlig ved hjelp av utstyr, teknologi eller programvare oppført i vedlegg V, gir tilgang til og utlevering av innholdet i en persons innkommende og utgående telekommunikasjoner og trafikkdata med sikte på uttrekk, avkoding, opptak, behandling, analyse og lagring eller enhver annen tilhørende aktivitet.

å importere råolje eller oljeprodukter til EU dersom de har opprinnelse i Syria, eller er eksportert fra Syria, å kjøpe råolje eller oljeprodukter som befinner seg eller har opprinnelse i Syria, å transportere råolje eller oljeprodukter dersom de har opprinnelse i Syria eller eksporteres fra Syria til et annet land, å yte, direkte eller indirekte, finansiering eller finansiell bistand, herunder finansielle derivater, samt forsikring og gjenforsikring som gjelder forbudene fastsatt i bokstav a), b) og c), og forsettlig å delta i aktiviteter som har som formål eller følge, direkte eller indirekte, å omgå forbudene nevnt i bokstav a), b), c) eller d) ovenfor.

den kompetente myndigheten, på grunnlag av tilgjengelige opplysninger, herunder opplysninger fra personen, enheten eller organet som søker om tillatelsen, har fastslått at det er rimelig å konkludere med at formålet med den aktuelle virksomheten er å levere bistand til den syriske sivilbefolkningen, særlig med sikte på å oppfylle humanitære behov, bidra til yting av grunnleggende tjenester, gjenoppbygging eller gjenoppretting av næringsvirksomhet eller andre sivile formål, den aktuelle virksomheten ikke innebærer at penger eller formuesgoder stilles til rådighet, verken direkte eller indirekte, eller er til fordel for personer, enheter eller organer nevnt i artikkel 14, den aktuelle virksomheten ikke er i strid med noen av bestemmelsene fastsatt i denne forordning, den berørte medlemsstaten på forhånd har kontaktet personen, enheten eller organet utpekt av Nasjonalkoalisjonen for de demokratiske og revolusjonære kreftene i Syria når det gjelder blant annet den kompetente myndighetens avgjørelse etter bokstav a) i) og ii), eventuelle tilgjengelige opplysninger som antyder at den aktuelle virksomheten kan innebære at penger eller formuesgoder stilles til rådighet, direkte eller indirekte, eller kan være til fordel for personer, enheter eller organer nevnt i artikkel 2 i forordning (EF) nr. 2580/2001 av 27. desember 2001 om spesifikke restriktive tiltak rettet mot visse personer og enheter med sikte på å bekjempe terrorisme eller i artikkel 2 i forordning (EF) nr. 881/2002 av 27. mai 2002 om spesifikke restriktive tiltak rettet mot visse personer og enheter tilknyttet Al Qaida-nettverket, og personen, enheten eller organet utpekt av Nasjonalkoalisjonen for de demokratiske og revolusjonære kreftene i Syria har kommet med sine synspunkter til vedkommende medlemsland. Dersom den kompetente myndigheten ikke har mottatt noen synspunkter fra personen, enheten eller organet utpekt av Nasjonalkoalisjonen for de demokratiske og revolusjonære kreftene i Syria senest 30 dager etter at forespørselen ble fremlagt, kan den kompetente myndigheten gå videre med beslutningen om tillatelsen skal gis eller ikke.

2. Når den kompetente myndigheten anvender betingelsene i nr. 1 bokstav a) og b), skal den be om tilfredsstillende opplysninger om hvordan tillatelsen skal brukes, herunder opplysninger om motpartene i transaksjonen.

3. Medlemsstaten skal informere de andre medlemsstatene og Kommisjonen innen to uker om tillatelser som er gitt i henhold til denne artikkel.

oppfyllelse på eller innen 15. november 2011 av en forpliktelse som følger av kontrakter inngått før 2. september 2011, forutsatt at den fysiske eller juridiske personen, enheten eller organet som ønsker å oppfylle forpliktelsen, senest syv arbeidsdager før oppfyllelsen har underrettet den kompetente myndighet i medlemsstaten der den er etablert, som angitt på nettsidene oppført i vedlegg III, om aktiviteten eller transaksjonen som skal utføres, eller kjøp av råolje eller oljeprodukter som ble eksportert fra Syria før 2. september 2011, eller der eksporten ble foretatt i henhold til bokstav a), på eller innen 15. november 2011.

1. Det er forbudt å selge, levere, overføre eller eksportere, direkte eller indirekte, utstyr eller teknologi som er oppført i vedlegg VI, til personer, enheter eller organer i Syria eller til bruk i Syria.

leting etter råolje og naturgass, utvinning av råolje og naturgass, raffinering, kondensering av naturgass.

3. Vedlegg VI skal ikke omfatte artikler som er oppført på EUs felles liste over forsvarsutstyr.

å yte, direkte eller indirekte, faglig bistand og formidlingstjenester i tilknytning til utstyr og teknologi som er oppført i vedlegg VI, eller i tilknytning til levering, produksjon, vedlikehold og bruk av varer som er oppført i vedlegg VI, til syriske personer, enheter eller organer eller til bruk i Syria, å yte, direkte eller indirekte, finansiering eller finansiell bistand i tilknytning til utstyr og teknologi som er oppført i vedlegg VI, til syriske personer, enheter eller organer eller til bruk i Syria, og forsettlig å delta i aktiviteter som har som formål eller følge å omgå forbudene nevnt i bokstav a) eller b).

den kompetente myndigheten, på grunnlag av tilgjengelige opplysninger, herunder opplysninger fra personen, enheten eller organet som søker om tillatelsen, har fastslått at det er rimelig å konkludere med at formålet med den aktuelle virksomheten er å levere bistand til den syriske sivilbefolkningen, særlig med sikte på å oppfylle humanitære behov, bidra til yting av grunnleggende tjenester, gjenoppbygging eller gjenoppretting av næringsvirksomhet eller andre sivile formål, den aktuelle virksomheten ikke innebærer at penger eller formuesgoder stilles til rådighet, verken direkte eller indirekte, eller er til fordel for personer, enheter eller organer nevnt i artikkel 14, den aktuelle virksomheten ikke er i strid med noen av bestemmelsene fastsatt i denne forordning, den berørte medlemsstaten på forhånd har kontaktet personen, enheten eller organet utpekt av Nasjonalkoalisjonen for de demokratiske og revolusjonære kreftene i Syria når det gjelder blant annet den kompetente myndighetens avgjørelse etter bokstav a) i) og ii), eventuelle tilgjengelige opplysninger som antyder at den aktuelle virksomheten kan innebære at penger eller formuesgoder stilles til rådighet, direkte eller indirekte, eller kan være til fordel for personer, enheter eller organer nevnt i artikkel 2 i forordning (EF) nr. 2580/2001 eller i artikkel 2 i forordning (EF) nr. 881/2002, og personen, enheten eller organet utpekt av Nasjonalkoalisjonen for de demokratiske og revolusjonære kreftene i Syria har lagt frem sine synspunkter for vedkommende medlemsstat. Dersom den kompetente myndigheten ikke har mottatt noen synspunkter fra personen, enheten eller organet utpekt av Nasjonalkoalisjonen for de demokratiske og revolusjonære kreftene i Syria senest 30 dager etter at forespørselen ble fremlagt, kan den kompetente myndigheten gå videre med beslutningen om tillatelsen skal gis eller ikke.

2. Når den kompetente myndigheten anvender betingelsene i nr. 1 bokstav a) og b), skal den be om tilfredsstillende opplysninger om hvordan tillatelsen skal brukes, herunder opplysninger om sluttbrukeren og det endelige bestemmelsesstedet for leveransen.

3. Medlemsstaten skal informere de andre medlemsstatene og Kommisjonen innen to uker om tillatelser som er gitt i henhold til denne artikkel.

1. Forbudene i artikkel 8 og 9 gjelder ikke oppfyllelsen av en forpliktelse som følger av en kontrakt som ble tildelt eller inngått innen 19. januar 2012, forutsatt at personen eller enheten som ønsker å påberope seg denne artikkel, minst 21 kalenderdager på forhånd har underrettet den kompetente myndighet i medlemsstaten der de er etablert, som angitt på nettsidene oppført i vedlegg III, om dette.

2. I denne artikkel anses en kontrakt som tildelt en person eller enhet dersom det er sendt uttrykkelig skriftlig bekreftelse på tildelingen av kontrakten til denne personen eller enheten av den annen kontraktspart etter at en formell anbudsprosess er gjennomført.

Det er forbudt å selge, levere, overføre eller eksportere, direkte eller indirekte, nye banksedler og mynter i syrisk valuta som er trykket eller preget i EU, til Syrias sentralbank.

å selge, levere, overføre eller eksportere, direkte eller indirekte, gull, edle metaller og diamanter som er oppført i vedlegg VIII, uavhengig av om de har sin opprinnelse i Den europeiske union eller ikke, til Syrias regjering, dens offentlige organer, foretak og etater, Syrias sentralbank og personer, enheter eller organer som handler på deres vegne eller på deres instruks, eller enheter eller organer som eies eller kontrolleres av dem, å kjøpe, importere eller transportere, direkte eller indirekte, gull, edle metaller og diamanter som er oppført i vedlegg VIII, uavhengig av om de har sin opprinnelse i Syria eller ikke, fra Syrias regjering, dens offentlige organer, foretak og etater, Syrias sentralbank og personer, enheter eller organer som handler på deres vegne eller på deres instruks, eller enheter eller organer som eies eller kontrolleres av dem, og å yte, direkte eller indirekte, faglig bistand og formidlingstjenester, finansiering eller finansiell bistand knyttet til varene nevnt i bokstav a) og b) til Syrias regjering, dens offentlige organer, foretak og etater, Syrias sentralbank og personer, enheter eller organer som handler på deres vegne eller på deres instruks, eller enheter eller organer som eies eller kontrolleres av dem.

2. Vedlegg VIII inneholder en liste over gull, edle metaller og diamanter som omfattes av forbudene nevnt i nr. 1.

å selge, levere, overføre eller eksportere, direkte eller indirekte, luksusvarer som er oppført i vedlegg X til Syria, forsettlig å delta i aktiviteter som direkte eller indirekte har som formål eller følge å omgå forbudet nevnt i bokstav a).

2. Som unntak fra bestemmelsene i nr. 1 bokstav a) skal forbudet som der er nevnt, ikke gjelde varer av ikke-kommersiell art til personlig bruk i reisendes bagasje.

Kapittel III Restriksjoner på deltakelse i infrastrukturprosjekter

å selge, levere, overføre eller eksportere utstyr eller teknologi som er oppført i vedlegg VII som skal brukes til bygging eller installering av nye kraftverk for strømproduksjon i Syria, å yte, direkte eller indirekte, faglig bistand, finansiering eller finansiell bistand, herunder finansielle derivater, samt forsikring eller gjenforsikring i forbindelse med prosjekter som nevnt i bokstav a).

2. Dette forbudet gjelder ikke for oppfyllelsen av en forpliktelse som følger av en kontrakt eller avtale som ble inngått innen 19. januar 2012, forutsatt at personen eller enheten som ønsker å påberope seg denne artikkel, minst 21 kalenderdager på forhånd har underrettet den kompetente myndighet i medlemsstaten der de er etablert, som angitt på nettsidene oppført i vedlegg III, om dette.

Kapittel IV Restriksjoner på finansiering av bestemte foretak

å yte lån eller kreditt til syriske personer, enheter eller organer nevnt i nr. 2, å erverve eller utvide en andel i syriske personer, enheter eller organer nevnt i nr. 2, å opprette fellesforetak med syriske personer, enheter eller organer nevnt i nr. 2, forsettlig å delta i aktiviteter som har som formål eller følge å omgå forbudene nevnt i bokstav a), b) eller c) ovenfor.

leting etter, utvinning av eller raffinering av råolje, eller bygging eller installering av nye kraftverk for strømproduksjon.

«leting etter råolje» omfatter leting og prospektering etter og forvaltning av råoljereserver samt yting av geologiske tjenester i forbindelse med slike reserver, «raffinering av råolje» omfatter prosessering, kondisjonering og klargjøring av oljen til, i siste instans, endelig salg av brensel.

gjelder med forbehold for forpliktelser som følger av kontrakter eller avtaler i forbindelse med leting etter, utvinning av eller raffinering av råolje som er inngått før 23. september 2011, bygging eller installering av nye kraftverk for strømproduksjon som er inngått før 19. januar 2012, skal ikke forhindre utvidelse av en andel i forbindelse med leting etter, utvinning av eller raffinering av råolje, dersom en slik utvidelse er en forpliktelse i henhold til en avtale inngått før 23. september 2011, bygging eller installering av nye kraftverk for strømproduksjon, dersom en slik utvidelse er en forpliktelse i henhold til en avtale inngått før 19. januar 2012.

den kompetente myndigheten, på grunnlag av tilgjengelige opplysninger, herunder opplysninger fra personen, enheten eller organet som søker om tillatelsen, har fastslått at det er rimelig å konkludere med at formålet med den aktuelle virksomheten er å levere bistand til den syriske sivilbefolkningen, særlig med sikte på å oppfylle humanitære behov, bidra til yting av grunnleggende tjenester, gjenoppbygging eller gjenoppretting av næringsvirksomhet eller andre sivile formål, den aktuelle virksomheten ikke innebærer at penger eller formuesgoder stilles til rådighet, verken direkte eller indirekte, eller er til fordel for personer, enheter eller organer nevnt i artikkel 14, den aktuelle virksomheten ikke er i strid med noen av bestemmelsene fastsatt i denne forordning, den berørte medlemsstaten på forhånd har kontaktet personen, enheten eller organet utpekt av Nasjonalkoalisjonen for de demokratiske og revolusjonære kreftene i Syria når det gjelder blant annet den kompetente myndighetens avgjørelse etter bokstav a) i) og ii), eventuelle tilgjengelige opplysninger som antyder at den aktuelle virksomheten kan innebære at penger eller formuesgoder stilles til rådighet, direkte eller indirekte, eller kan være til fordel for personer, enheter eller organer nevnt i artikkel 2 i forordning (EF) nr. 2580/2001 eller i artikkel 2 i forordning (EF) nr. 881/2002, og personen, enheten eller organet utpekt av Nasjonalkoalisjonen for de demokratiske og revolusjonære kreftene i Syria har kommet med sine synspunkter til vedkommende medlemsland. Dersom den kompetente myndigheten ikke har mottatt noen synspunkter fra personen, enheten eller organet utpekt av Nasjonalkoalisjonen for de demokratiske og revolusjonære kreftene i Syria senest 30 dager etter at forespørselen ble fremlagt, kan den kompetente myndigheten gå videre med beslutningen om tillatelsen skal gis eller ikke.

2. Når den kompetente myndigheten anvender betingelsene i nr. 1 bokstav a) og b), skal den be om tilfredsstillende opplysninger om hvordan tillatelsen skal brukes, herunder opplysninger om formålet med og motpartene i transaksjonen.

3. Medlemsstaten skal informere de andre medlemsstatene og Kommisjonen innen to uker om tillatelser som er gitt i henhold til denne artikkel.

Kapittel V Frysing av penger og formuesgoder

1. Alle penger og formuesgoder som tilhører, eies, innehas eller kontrolleres av de fysiske eller juridiske personene, enhetene eller organene oppført i vedlegg II eller IIa, skal fryses.

2. Ingen penger eller formuesgoder skal stilles til rådighet, verken direkte eller indirekte, eller være til fordel for de fysiske eller juridiske personene, enhetene eller organene som er oppført i vedlegg II og IIa.

3. Det er forbudt forsettlig å delta i aktiviteter som direkte eller indirekte har som formål eller følge å omgå tiltakene nevnt i nr. 1 og 2.

Vedlegg II inneholder en liste over fysiske eller juridiske personer, enheter og organer som, i samsvar med artikkel 19 nr. 1 i beslutning 2011/782/FUSP, av Rådet er identifisert som personer eller enheter som er ansvarlige for den voldelige undertrykkingen av sivilbefolkningen i Syria, personer og enheter som drar fordel av eller støtter regimet, og fysiske eller juridiske personer og enheter som er knyttet til dem, og som ikke omfattes av bestemmelsene i artikkel 21 i denne forordning, vedlegg IIa inneholder en liste over enheter som, i samsvar med artikkel 19 nr. 1 i beslutning 2011/782/FUSP, av Rådet er identifisert som enheter knyttet til personer eller enheter som er ansvarlige for den voldelige undertrykkingen av sivilbefolkningen i Syria, eller til personer og enheter som drar fordel av eller støtter regimet, og som ikke omfattes av bestemmelsene i artikkel 21 i denne forordning.

2. Vedlegg II og IIa inneholder begrunnelsen for at de berørte personer, enheter og organer er listeført.

3. Vedlegg II og IIa inneholder også, der det er tilgjengelig, nødvendige opplysninger for å identifisere de berørte fysiske eller juridiske personene, enhetene eller organene. For fysiske personer kan dette omfatte navn, herunder dekknavn, fødselsdato og fødested, statsborgerskap, passnummer og identitetskortnummer, kjønn, adresse, dersom denne er kjent, og stilling eller yrke. For juridiske personer, enheter og organer kan dette omfatte navn, registreringsdato og -sted, registreringsnummer og forretningsadresse.

er nødvendige for å dekke de grunnleggende behov hos fysiske eller juridiske personer, enheter eller organer oppført i vedlegg II eller IIa og familiemedlemmene disse fysiske personene forsørger, herunder betaling av matvarer, husleie eller boliglån, medisiner og medisinsk behandling, skatter og avgifter, forsikringspremier og kommunale avgifter, utelukkende skal gå til betaling av rimelige honorarer og refusjon av utgifter i forbindelse med juridisk bistand, utelukkende skal gå til betaling av avgifter eller administrasjonsgebyr for rutinemessig oppbevaring eller forvaltning av frosne penger eller formuesgoder, er nødvendige for å dekke ekstraordinære utgifter, forutsatt at vedkommende kompetente myndighet minst to uker før tillatelsen gis, har underrettet de øvrige medlemsstaters kompetente myndigheter og Kommisjonen om begrunnelsen for at den mener at en bestemt tillatelse bør gis, skal betales til eller fra kontoen til en utenriksstasjon eller en internasjonal organisasjon som har immunitet i henhold til folkeretten, dersom betalingene er forutsatt benyttet til offisielle formål på utenriksstasjonen eller i den internasjonale organisasjonen, er nødvendige for humanitære formål, som å yte eller legge til rette for yting av bistand, herunder medisinsk utstyr, matvarer, humanitære hjelpearbeidere og tilhørende bistand, eller evakuering fra Syria, er nødvendige av hensyn til personsikkerheten eller miljøet.

Medlemsstaten skal underrette de øvrige medlemsstatene og Kommisjonen om alle tillatelser som gis i henhold til denne artikkel, senest fire uker etter at tillatelsen er gitt.

Som unntak fra bestemmelsene i artikkel 14 kan medlemsstatenes kompetente myndigheter, som angitt på nettsidene oppført i vedlegg III, gi tillatelse, på de vilkår de finner hensiktsmessige, til å frigi eller stille visse frosne penger eller formuesgoder til rådighet når det er fastslått at pengene eller formuesgodene er nødvendige for den syriske sivilbefolkningens grunnleggende energibehov, forutsatt at vedkommende kompetente myndighet minst fire uker tidligere, for hver enkelt kontrakt, har underrettet de øvrige medlemsstaters kompetente myndigheter og Kommisjonen om begrunnelsen for at den mener at en bestemt tillatelse bør gis.

pengene eller formuesgodene er gjenstand for en voldgiftsdom avsagt før den dato den fysiske eller juridiske personen, enheten eller organet nevnt i artikkel 14 ble listeført i vedlegg II eller IIa, eller for en rettslig eller administrativ beslutning fastsatt i EU, eller en rettslig beslutning som er rettskraftig i vedkommende medlemsstat, før eller etter denne datoen, pengene eller formuesgodene utelukkende skal brukes til å innfri fordringer som er sikret gjennom eller anerkjent som gyldige i en slik beslutning, innenfor de rammer som er fastsatt i gjeldende lov og forskrift om slike fordringshaveres rettigheter, beslutningen ikke er til fordel for en fysisk eller juridisk person, en enhet eller et organ som er oppført i vedlegg II eller IIa, anerkjennelse av beslutningen ikke er i strid med vedkommende medlemsstats offentlige orden.

2. Medlemsstaten skal informere de andre medlemsstatene og Kommisjonen om tillatelser som er gitt i henhold til denne artikkel.

renter eller andre former for avkastning på disse kontiene, eller beløp forfalt til betaling i henhold til kontrakter, avtaler eller forpliktelser som var inngått eller oppstod før datoen da kontoen ble omfattet av denne forordning,

når disse rentene, avkastningene eller betalingene er frosset i henhold til artikkel 14 nr. 1.

beløp forfalt til betaling i henhold til rettslige, administrative eller voldgiftsmessige beslutninger som er fattet i en medlemsstat, eller som er rettskraftige i vedkommende medlemsstat.

2. Bestemmelsene i artikkel 14 nr. 2 skal ikke forhindre finans- eller kredittinstitusjoner i EU i å godskrive frosne konti når de mottar penger overført til en konto tilhørende listeførte fysiske eller juridiske personer, enheter eller organer, forutsatt at de godskrevne beløpene også fryses. Finans- eller kredittinstitusjonen skal umiddelbart underrette vedkommende kompetente myndighet om slike transaksjoner.

Som unntak fra bestemmelsene i artikkel 14 kan medlemsstatenes kompetente myndigheter, som angitt på nettsidene oppført i vedlegg III, i tilfeller der personer, enheter eller organer oppført i vedlegg II eller IIA skal betale beløp forfalt i henhold til en kontrakt, avtale eller forpliktelse som vedkommende personer, enheter eller organer har inngått eller pådratt seg før datoen for listeføringen av dem, gi tillatelse, på de vilkår de finner hensiktsmessige, til å frigi visse frosne penger eller formuesgoder dersom betalingen ikke direkte eller indirekte mottas av en person eller enhet nevnt i artikkel 14.

Som unntak fra bestemmelsene i artikkel 14 kan medlemsstatenes kompetente myndigheter, som angitt på nettsidene oppført i vedlegg III, gi tillatelse, på de vilkår de finner hensiktsmessige, til overføringer ved eller gjennom et finansforetak oppført i vedlegg II eller IIa av penger eller formuesgoder, dersom overføringen gjelder en betaling fra en person eller enhet som ikke er oppført i vedlegg II eller IIa, i forbindelse med levering av finansiell støtte til syriske statsborgere som tar utdanning, får yrkesopplæring eller driver akademisk forskning i EU, forutsatt at den relevante medlemsstatens kompetente myndigheter i hvert enkelt tilfelle har fastslått at betalingen ikke direkte eller indirekte vil gå til en person eller enhet oppført i vedlegg II eller IIa.

Betalingen forfaller i henhold til en handelskontrakt, og den relevante medlemsstatens kompetente myndigheter har fastslått at betalingen ikke direkte eller indirekte vil gå til en person eller enhet oppført i vedlegg II eller IIa.

en overføring fra eller gjennom Syrias sentralbank av penger eller formuesgoder som er mottatt eller frosset etter listeføringsdatoen, dersom overføringen gjelder en betaling i forbindelse med en bestemt handelskontrakt, eller en overføring av penger eller formuesgoder til eller gjennom Syrias sentralbank dersom overføringen gjelder en betaling i forbindelse med en bestemt handelskontrakt,

forutsatt at den relevante medlemsstatens kompetente myndigheter i hvert enkelt tilfelle har fastslått at betalingen ikke direkte eller indirekte vil gå til en person eller enhet oppført i vedlegg II eller IIa, og forutsatt at overføringen ikke ellers er forbudt i henhold til denne forordning.

2. Som unntak fra bestemmelsene i artikkel 14 kan medlemsstatenes kompetente myndigheter, som angitt på nettsidene oppført i vedlegg III, gi tillatelse, på de vilkår de finner hensiktsmessige, til en overføring fra eller gjennom Syrias sentralbank av frosne penger eller formuesgoder for å gi finansinstitusjoner som er innenfor medlemsstatenes jurisdiksjon, likviditet til å finansiere handel.

Bestemmelsene i artikkel 14 nr. 2 skal ikke forhindre at det gjennomføres handlinger eller transaksjoner overfor Syrian Arab Airlines utelukkende med det formål å evakuere EU-borgere og deres familiemedlemmer fra Syria.

Dersom penger og formuesgoder fryses eller ikke stilles til rådighet og dette gjøres i god tro på det grunnlag at slike tiltak er i samsvar med denne forordning, skal dette ikke medføre noen form for ansvar for den fysiske eller juridiske personen, enheten eller organet som gjennomfører tiltaket, eller deres ledere eller ansatte, med mindre det kan bevises at pengene eller formuesgodene ble fryst eller tilbakeholdt som følge av uaktsomhet.

Kapittel VI Restriksjoner på finansielle tjenester

ikke ha anledning til å foreta utbetalinger i henhold til eller i forbindelse med eksisterende låneavtaler inngått mellom staten Syria eller syriske offentlige myndigheter og EIB, og midlertidig oppheve alle eksisterende tjenesteavtaler om faglig bistand som gjelder prosjekter finansiert gjennom låneavtalene nevnt i bokstav a), og som direkte eller indirekte er til fordel for staten Syria eller landets offentlige myndigheter.

å selge eller kjøpe syriske statsobligasjoner eller statsgaranterte obligasjoner utstedt etter 19. januar 2012, direkte eller indirekte, til eller fra følgende: staten Syria eller dens regjering samt dens offentlige organer, foretak og etater, syriske kreditt- eller finansinstitusjoner, fysiske eller juridiske personer, enheter eller organer som opptrer på vegne av eller på instruks fra juridiske personer, enheter eller organer nevnt i nr. i) eller ii), juridiske personer, enheter eller organer som eies eller kontrolleres av personer, enheter eller organer nevnt i nr. i), ii) eller iii), å yte formidlingstjenester når det gjelder syriske statsobligasjoner eller statsgaranterte obligasjoner utstedt etter 19. januar 2012 til personer, enheter eller organer nevnt i bokstav a), å bistå personer, enheter eller organer nevnt i bokstav a) med å utstede syriske statsobligasjoner eller statsgaranterte obligasjoner, ved å yte formidlingstjenester, markedsføringstjenester eller andre tjenester knyttet til slike obligasjoner.

å åpne en ny bankkonto hos syriske kreditt- eller finansinstitusjoner, å opprette en ny korrespondentbankforbindelse med syriske kreditt- eller finansinstitusjoner, å åpne et nytt representasjonskontor i Syria eller etablere en ny filial eller et nytt datterselskap i Syria, å opprette et nytt fellesforetak med syriske kreditt- eller finansinstitusjoner.

å gi tillatelse til at det åpnes et representasjonskontor eller opprettes en filial eller et datterselskap i Den europeiske union av syriske kreditt- eller finansinstitusjoner, å inngå avtaler for eller på vegne av syriske kreditt- eller finansinstitusjoner om åpning av et representasjonskontor eller oppretting av en filial eller et datterselskap i Den europeiske union, å gi et representasjonskontor, en filial eller et datterselskap av en syrisk kreditt- eller finansinstitusjon tillatelse til å starte opp og utøve virksomhet som kreditt- eller finansinstitusjon eller enhver annen virksomhet som krever forhåndstillatelse, dersom representasjonskontoret, filialen eller datterselskapet ikke var i drift innen 19. januar 2012, for en syrisk kreditt- eller finansinstitusjon, å kjøpe eller utvide en andel eller å kjøpe andre eierskapsinteresser i en kreditt- eller finansinstitusjon nevnt i artikkel 35.

den kompetente myndigheten, på grunnlag av tilgjengelige opplysninger, herunder opplysninger fra personen, enheten eller organet som søker om tillatelsen, har fastslått at det er rimelig å konkludere med at formålet med den aktuelle virksomheten er å levere bistand til den syriske sivilbefolkningen, særlig med sikte på å oppfylle humanitære behov, bidra til yting av grunnleggende tjenester, gjenoppbygging eller gjenoppretting av næringsvirksomhet eller andre sivile formål, den aktuelle virksomheten ikke innebærer at penger eller formuesgoder stilles til rådighet, verken direkte eller indirekte, eller er til fordel for personer, enheter eller organer nevnt i artikkel 14, den aktuelle virksomheten ikke er i strid med noen av bestemmelsene fastsatt i denne forordning, den berørte medlemsstaten på forhånd har kontaktet personen, enheten eller organet utpekt av Nasjonalkoalisjonen for de demokratiske og revolusjonære kreftene i Syria når det gjelder blant annet den kompetente myndighetens avgjørelse etter bokstav a) i) og ii), eventuelle tilgjengelige opplysninger som antyder at den aktuelle virksomheten kan innebære at penger eller formuesgoder stilles til rådighet, direkte eller indirekte, eller kan være til fordel for personer, enheter eller organer nevnt i artikkel 2 i forordning (EF) nr. 2580/2001 eller i artikkel 2 i forordning (EF) nr. 881/2002, og personen, enheten eller organet utpekt av Nasjonalkoalisjonen for de demokratiske og revolusjonære kreftene i Syria har kommet med sine synspunkter til vedkommende medlemsland. Dersom den kompetente myndigheten ikke har mottatt noen synspunkter fra personen, enheten eller organet utpekt av Nasjonalkoalisjonen for de demokratiske og revolusjonære kreftene i Syria senest 30 dager etter at forespørselen ble fremlagt, kan den kompetente myndigheten gå videre med beslutningen om tillatelsen skal gis eller ikke.

2. Når den kompetente myndigheten anvender betingelsene i nr. 1 bokstav a) og b), skal den be om tilfredsstillende opplysninger om hvordan tillatelsen skal brukes, herunder opplysninger om formålet med og motpartene i den aktuelle virksomheten.

3. Medlemsstaten skal informere de andre medlemsstatene og Kommisjonen innen to uker om tillatelser som er gitt i henhold til denne artikkel.

å yte forsikring eller gjenforsikring til staten Syria eller dens regjering samt dens offentlige organer, foretak eller etater, eller fysiske eller juridiske personer, enheter eller organer som opptrer på vegne av eller etter instruks fra juridiske personer, enheter eller organer nevnt i nr. i), forsettlig å delta i aktiviteter som har som formål eller følge å omgå forbudene nevnt i bokstav a).

2. Bestemmelsene i nr. 1 bokstav a) gjelder ikke levering av obligatorisk forsikring eller ansvarsforsikring til syriske personer, enheter eller organer som er basert innenfor EU, eller levering av forsikring til syriske utenriksstasjoner i EU.

Bestemmelsene i nr. 1 bokstav a) ii) skal ikke være til hinder for at det gis forsikring eller gjenforsikring til eieren av et fartøy, luftfartøy eller kjøretøy som chartres av personer, enheter eller organer som er nevnt i nr. 1 bokstav a) i), og som ikke er oppført i vedlegg II eller IIa.

I nr. 1 bokstav a) ii) skal personer, enheter eller organer anses som ikke å handle på instruks fra personer, enheter eller organer nevnt i nr. 1 bokstav a) i) dersom denne instruksen gjelder dokking, lasting, lossing eller sikker transitt av et fartøy eller luftfartøy som midlertidig befinner seg i syrisk farvann eller luftrom.

4. Denne artikkel forbyr forlenging eller fornying av forsikrings- og gjenforsikringsavtaler inngått før 19. januar 2012 (unntatt der det allerede foreligger en kontraktsmessig forpliktelse for forsikrings- eller gjenforsikringsgiveren til å godta en forlenging eller fornying av en polise), men, med forbehold om bestemmelsene i artikkel 14 nr. 2, er den ikke til hinder for at kontrakter inngått før denne datoen overholdes.

Kapittel VI Restriksjoner på transport

luftfartøyet brukes i ikke regelbundne internasjonale luftfartstjenester og landingen har ikke-trafikkmessige formål eller gjelder ikke-kommersiell luftfartsvirksomhet, eller luftfartøyet brukes i regelbundne internasjonale luftfartstjenester og landingen har ikke-trafikkmessige formål,

som fastsatt i Chicago-overenskomsten om internasjonal sivil luftfart eller den internasjonale transittavtalen om lufttrafikk.

2. Bestemmelsene i nr. 1 gjelder ikke flyginger som utelukkende gjennomføres for å evakuere EU-borgere og deres familiemedlemmer fra Syria.

3. Det er forbudt forsettlig å delta i aktiviteter som har som formål eller følge å omgå forbudet nevnt i nr. 1.

Kapittel VII Generelle bestemmelser og sluttbestemmelser

Ingen krav, herunder krav om kompensasjon eller erstatning eller andre krav av denne typen, som motregningskrav, bøter eller krav i henhold til en garanti, krav om utvidelse eller betaling av en obligasjon, finansielle garantier, herunder krav som fremgår av remburser og lignende instrumenter i forbindelse med kontrakter eller transaksjoner der gjennomføringen er påvirket, direkte eller indirekte, helt eller delvis, av tiltakene som pålegges gjennom denne forordning, skal imøtekommes overfor Syrias regjering, dens offentlige organer, foretak og etater eller overfor personer eller enheter som fremsetter krav gjennom eller til fordel for Syrias regjering.

Forbudene fastsatt i denne forordning skal ikke medføre noen form for ansvar for de pågjeldende fysiske eller juridiske personene, enhetene eller organene dersom de ikke hadde kjennskap til eller skjellig grunn til å anta at deres handling ville være i strid med disse forbudene.

1. Når Rådet beslutter at en fysisk eller juridisk person, en enhet eller et organ skal omfattes av tiltakene nevnt i artikkel 14, skal vedlegg II eller IIa endres tilsvarende.

2. Rådet skal meddele sin beslutning, herunder begrunnelsen for listeføringen, til den fysiske eller juridiske personen, enheten eller organet nevnt i nr. 1, enten direkte, dersom adressen er kjent, eller ved offentliggjøring av en kunngjøring, der den fysiske eller juridiske personen, enheten eller organet gis anledning til å komme med merknader.

3. Dersom det kommer merknader eller fremlegges vesentlige nye bevis, skal Rådet ta beslutningen opp til fornyet behandling og informere den fysiske eller juridiske personen, enheten eller organet om dette.

4. Listene i vedlegg II og IIa skal gjennomgås med jevne mellomrom og minst hver 12. måned.

1. Medlemsstatene skal fastsette regler for sanksjoner ved brudd på bestemmelsene i denne forordning og skal treffe alle nødvendige tiltak for å sikre at de blir gjennomført. Disse sanksjonene må være effektive, forholdsmessige og forebyggende.

2. Medlemsstatene skal underrette Kommisjonen om disse reglene umiddelbart etter 19. januar 2012 og om alle senere endringer.

Introductory Notes

This Part comprises goods, software and technology listed in Annex I to Regulation (EC) No 428/2009. 1

Unless otherwise stated, the reference numbers used in the column below entitled «No» refer to the control list number and the column below entitled «Description» refers to the control descriptions of dual-use items set out in Annex I to Regulation (EC) No 428/2009.

Definitions of terms between 'single quotation marks' are given in a technical note to the relevant item.

Definitions of terms between «double quotation marks» can be found in Annex I to Regulation (EC) No 428/2009.

General Notes

The object of the controls contained in this Annex should not be defeated by the export of any non-controlled goods (including plant) containing one or more controlled components when the controlled component or components is/are the principal element of the goods and can feasibly be removed or used for other purposes.

NB: In judging whether the controlled component or components is/are to be considered the principal element, it is necessary to weigh the factors of quantity, value and technological know-how involved and other special circumstances which might establish the controlled component or components as the principal element of the goods being procured .

The items specified in this Annex include both new and used goods.

General Technology Note (GTN) (To be read in conjunction with Section B of this Part)

The sale, supply, transfer or export of «technology» which is «required» for the «development», «production» or «use» of goods the sale, supply, transfer or export of which is controlled in Sections A, B, C and D of this Part, is controlled in accordance with the provisions of Section E.

The «technology» «required» for the «development», «production» or «use» of goods under control remains under control even when it is applicable to non-controlled goods.

Controls do not apply to that «technology» which is the minimum necessary for the installation, operation, maintenance (checking) and repair of those goods which are not controlled or the export of which has been authorised in accordance with this Regulation.

Controls on «technology» transfer do not apply to information «in the public domain», to «basic scientific research» or to the minimum necessary information for patent applications.

The object of the prohibitions contained in this Annex should not be defeated by the export of any non-prohibited goods (including plant) containing one or more prohibited components when the prohibited component or components are the principal element of the goods and can feasibly be removed or used for other purposes.
