Forskrift om restriktive tiltak vedrørende handlinger som undergraver eller truer Ukrainas territorielle integritet, suverenitet, uavhengighet og stabilitet

Kapittel 1. Innledende bestemmelser
§ 1 . Virkeområde
på norsk territorium, inkludert norsk luftrom om bord på alle luftfartøy eller fartøy under norsk jurisdiksjon overfor alle norske statsborgere uansett hvor de befinner seg overfor alle juridiske personer, enheter og organer som er etablert eller stiftet i henhold til norsk lovgivning overfor alle juridiske personer, enheter og organer med hensyn til forretningsvirksomhet de driver helt eller delvis i Norge.
§ 2 . Definisjoner
kontrakt eller transaksjon : enhver transaksjon, uansett form og uansett hvilke lover som kommer til anvendelse, bestående av en eller flere kontrakter eller lignende forpliktelser som er inngått mellom samme eller forskjellige parter; for dette formål omfatter uttrykket «kontrakt» obligasjoner, garantier og motgarantier, særlig finansielle garantier og motgarantier, og enhver kreditt, enten den er juridisk uavhengig av kontraktsforholdet eller ikke, samt enhver tilknyttet bestemmelse som har oppstått i henhold til eller i tilknytning til transaksjonen formuesgoder : alle typer aktiva, materielle eller immaterielle, fast eiendom eller løsøre, som ikke er penger, men som kan benyttes til å skaffe penger, varer eller tjenester frysing av formuesgoder : å forhindre at formuesgoder på noen måte benyttes til å skaffe penger, varer eller tjenester, herunder, men ikke begrenset til, å selge, leie ut eller pantsette dem penger : finansielle aktiva og fordeler av enhver art, herunder, men ikke begrenset til kontante pengebeløp, sjekker, fordringer, veksler, anvisninger og andre betalingsinstrumenter innestående hos finansinstitusjoner eller hos andre virksomheter, saldoer på konti, tilgodehavende og tilgodehavendebevis børsnoterte og unoterte finansielle instrumenter og gjeldsinstrumenter, herunder aksjer og andre eierandeler, verdipapirsertifikater, obligasjoner, gjeldsbrev, kjøps- eller tegningsretter, usikrede verdipapirer og derivatkontrakter renter, utbytte og andre inntekter av eller verdier påløpt på eller generert av aktiva kreditter, motregningsretter, garantier, oppfyllelsesgarantier eller andre finansielle forpliktelser remburser, konnossementer og pantebrev dokumenter som viser eierandeler i penger eller finansielle ressurser frysing av penger : å forhindre flytting, overføring, endring eller bruk av, tilgang til eller håndtering av penger på noen måte som kan medføre endringer i volum, mengde, plassering, eierskap, besittelse, art eller formål eller andre endringer som kan gjøre det mulig å bruke pengene, herunder porteføljeforvaltning varer med opprinnelse på Krim eller i Sevastopol : varer som i sin helhet er fremstilt på Krim eller i Sevastopol, eller som har gjennomgått en siste vesentlig bearbeiding der formidlingstjenester: forhandling eller organisering av transaksjoner med henblikk på kjøp, salg eller levering av varer og teknologi eller av finansielle og tekniske tjenester, herunder fra en tredjestat til en annen tredjestat, eller salg eller kjøp av varer og teknologi eller av finansielle og tekniske tjenester, herunder når disse befinner seg i tredjestater med henblikk på overføring til en annen tredjestat faglig bistand : enhver form for teknisk støtte i forbindelse med reparasjon, utvikling, produksjon, montering, prøving, vedlikehold eller enhver annen form for teknisk tjeneste, uansett om bistanden ytes i form av instruksjon, rådgivning, opplæring, overføring av driftskunnskaper eller ferdigheter eller konsulenttjenester; faglig bistand omfatter også muntlig bistand omsettelige verdipapirer : verdipapirer som kan omsettes på kapitalmarkedet, unntatt betalingsmidler, for eksempel: aksjer i selskaper og andre verdipapirer som kan sidestilles med aksjer i selskaper, ansvarlige selskaper eller andre foretak, og depotbevis for aksjer, obligasjoner eller andre typer gjeldsinstrumenter, herunder depotbevis for slike verdipapirer alle andre verdipapirer som gir rett til å kjøpe eller selge slike omsettelige verdipapirer, eller som fører til kontantoppgjør pengemarkedsinstrumenter : instrumenter som vanligvis omsettes på pengemarkedet, for eksempel statskasseveksler, innskuddsbevis og sertifikater, unntatt betalingsmidler kredittinstitusjon : foretak hvis virksomhet består i å motta fra offentligheten innskudd eller andre midler som skal betales tilbake, og å yte kreditt for egen regning.
Kapittel 2. Finansielle restriksjoner
§ 3 . Påbud om frysing og forbud mot å gjøre tilgjengelig midler mv.
Alle penger og formuesgoder som tilhører, innehas eller kontrolleres av fysiske eller juridiske personer oppført i vedlegg I, eller av fysiske eller juridiske personer, tilknyttet disse personene, skal fryses.
Ingen penger eller formuesgoder skal stilles til rådighet, verken direkte eller indirekte, eller være til fordel for fysiske eller juridiske personer oppført i vedlegg I, eller for fysiske eller juridiske personer tilknyttet disse personene.
fysiske personer som er ansvarlige for, aktivt støtter eller gjennomfører handlinger eller politikk som undergraver eller truer Ukrainas territorielle integritet, suverenitet og uavhengighet eller stabiliteten eller sikkerheten i Ukraina, eller som hindrer internasjonale organisasjoners arbeid i Ukraina, samt fysiske eller juridiske personer tilknyttet disse personene, juridiske personer som materielt eller økonomisk støtter handlinger som undergraver eller truer Ukrainas territorielle integritet, suverenitet og uavhengighet, juridiske personer på Krim eller i Sevastopol hvis eierskap er overdratt i strid med ukrainsk lov, eller juridiske personer har dratt fordel av en slik overdragelse, eller fysiske eller juridiske personer som aktivt gir materiell eller økonomisk støtte til eller drar fordel av russiske beslutningstakere som er ansvarlige for annekteringen av Krim og Sevastopol eller destabiliseringen av Øst-Ukraina.
§ 4 . Unntak for å dekke grunnleggende behov mv.
er nødvendige for å dekke grunnleggende behov hos fysiske eller juridiske personer oppført i vedlegg I og familiemedlemmene disse fysiske personene forsørger, herunder betaling av matvarer, husleie eller boliglån, medisiner og medisinsk behandling, skatter og avgifter, forsikringspremier og kommunale avgifter, utelukkende skal gå til betaling av rimelige honorarer eller refusjon av utgifter i forbindelse med juridisk bistand, utelukkende skal gå til betaling av avgifter og administrasjonsgebyr for rutinemessig oppbevaring eller forvaltning av frosne penger eller formuesgoder, eller er nødvendige for å dekke ekstraordinære utgifter.
§ 5 . Unntak for betalinger i henhold til rettslige eller administrative avgjørelser
pengene eller formuesgodene er gjenstand for en voldgiftsdom avsagt før den dato den fysiske eller juridiske personen ble oppført i vedlegg I, eller for en rettslig eller administrativ beslutning i Norge, før eller etter denne datoen, pengene eller formuesgodene utelukkende skal brukes til å innfri fordringer som er sikret gjennom eller anerkjent som gyldige i en slik beslutning, innenfor de rammer som er fastsatt i gjeldende lov og forskrift om slike fordringshaveres rettigheter, og beslutningen ikke er til fordel for fysiske eller juridiske personer som er oppført i vedlegg I.
§ 6 . Unntak for forpliktelser forfalt før oppføringen
I tilfeller der fysiske eller juridiske personer oppført i vedlegg I skal betale beløp forfalt i henhold til en kontrakt, avtale eller forpliktelse som vedkommende fysiske eller juridiske person har inngått eller pådratt seg før den dato de ble oppført i vedlegg I, kan Utenriksdepartementet gjøre unntak fra bestemmelsene i § 3 og gi tillatelse, på de vilkår departementet finner hensiktsmessige, til å frigi visse frosne penger eller formuesgoder dersom betalingen ikke er i strid med § 3 annet ledd.
§ 7 . Overføringer til frosne konti
Bestemmelsen i § 3 annet ledd skal ikke forhindre finans- eller kredittinstitusjoner fra å godskrive frosne konti når de mottar penger overført av en tredjepart til en konto tilhørende listeførte fysiske eller juridiske personer forutsatt at de godskrevne beløpene også fryses. Finans- eller kredittinstitusjonen skal umiddelbart underrette Utenriksdepartementet om slike transaksjoner.
renter eller annen avkastning på disse kontiene, beløp forfalt til betaling i henhold til kontrakter, avtaler eller forpliktelser som var inngått eller oppstod før den dato den fysiske eller juridiske personen nevnt i § 3 ble oppført i vedlegg I, eller beløp forfalt til betaling i henhold til rettslige, administrative eller voldgiftsmessige beslutninger, når disse rentene eller andre inntekter og betalinger fryses i henhold til § 3 første ledd.
§ 8 . Rapporteringsplikt
Fysiske og juridiske personer skal omgående gi opplysninger som kan fremme overholdelse av denne forskrift, herunder opplysninger om konti og beløp som er frosset i samsvar med § 3, til Utenriksdepartementet.
Enhver opplysning som gis eller mottas i henhold til denne paragraf, skal brukes bare til det formål den gis eller mottas for.
Kapittel 3. Restriksjoner som gjelder Krim og Sevastopol
§ 9 . Forbud mot import av varer fra Krim og Sevastopol
å importere varer med opprinnelse på Krim eller i Sevastopol, å yte, direkte eller indirekte, finansiering eller finansiell bistand samt forsikring og gjenforsikring i tilknytning til import av varer som nevnt i bokstav a.
§ 10 . Finansieringsforbud
å gi finansielle lån eller kreditter som er spesifikt knyttet til etablering, anskaffelse eller utvikling av infrastruktur på områdene transport, telekommunikasjon og energi på Krim eller i Sevastopol, å erverve eller utvide en kapitalinteresse, herunder fullstendig ervervelse eller ervervelse av andeler og verdipapirer som har karakter av kapitalinteresse, i foretak etablert på Krim eller i Sevastopol som beskjeftiger seg med etablering, anskaffelse eller utvikling av infrastruktur på områdene transport, telekommunikasjon og energi på Krim eller i Sevastopol, å opprette fellesforetak knyttet til etablering, anskaffelse eller utvikling av infrastruktur på områdene transport, telekommunikasjon og energi på Krim eller i Sevastopol.
å gi finansielle lån eller kreditter som er spesifikt knyttet til utnyttelse av olje-, gass- eller mineralressurser omfattet av vedlegg II på Krim eller i Sevastopol, å erverve eller utvide en kapitalinteresse, herunder fullstendig ervervelse eller ervervelse av andeler og verdipapirer som har karakter av kapitalinteresse, i foretak etablert på Krim eller i Sevastopol som beskjeftiger seg med utnyttelse av olje-, gass- eller mineralressurser omfattet av vedlegg II på Krim eller i Sevastopol, å opprette fellesforetak knyttet til utnyttelse av olje-, gass- eller mineralressurser på Krim eller i Sevastopol.
Utnyttelse som nevnt i annet ledd omfatter leting etter og prospektering, utvinning, raffinering og forvaltning av olje-, gass og mineralressurser og yting av tilknyttede geologiske tjenester. Raffinering omfatter bearbeiding, foredling og forberedelse for salg. Vedlikehold for å ivareta sikkerheten til eksisterende infrastruktur omfattes ikke.
§ 11 . Forbud mot faglig bistand og formidlingstjenester
Det er forbudt direkte eller indirekte å yte faglig bistand eller formidlingstjenester knyttet til investeringsvirksomhet som nevnt i § 10.
§ 12 . Forbud mot salg mv. av vesentlig utstyr og teknologi
Det er forbudt direkte eller indirekte å selge, levere, overføre eller eksportere utstyr og teknologi som er oppført i vedlegg III, til fysiske eller juridiske personer på Krim eller i Sevastopol eller til bruk på Krim eller i Sevastopol.
transport, telekommunikasjon, energi, utnyttelse av olje-, gass-, og mineralreserver på Krim og i Sevastopol.
direkte eller indirekte å yte faglig bistand eller formidlingstjenester knyttet til vesentlig utstyr og teknologi som er oppført i vedlegg III, eller knyttet til levering, produksjon, vedlikehold eller bruk av produkter som er oppført i vedlegg III, til fysiske eller juridiske personer på Krim eller i Sevastopol eller til bruk på Krim eller i Sevastopol, direkte eller indirekte å yte finansiering eller finansiell bistand knyttet til vesentlig utstyr og teknologi som er oppført i vedlegg III, til fysiske eller juridiske personer på Krim eller i Sevastopol eller til bruk på Krim eller i Sevastopol.
Forbudene i første og tredje ledd får fram til 17. november 2014 ikke anvendelse på gjennomføring av transaksjoner som er påkrevd i henhold til en handelskontrakt inngått før 16. august 2014 med hensyn til vesentlig utstyr eller teknologi som oppført i vedlegg III, eller i henhold til tilknyttede kontrakter som er nødvendige for å oppfylle slike kontrakter, forutsatt at de fysiske eller juridiske personer som ønsker å foreta slike transaksjoner eller å gi bistand til slike transaksjoner, senest ti virkedager på forhånd har underrettet Utenriksdepartementet, om transaksjonen eller bistanden.
§ 13 . Unntak fra § 10 og § 11
transaksjonen er påkrevd i henhold til en avtale eller kontrakt som er inngått før 16. august 2014 og Utenriksdepartementet er blitt underrettet senest ti virkedager på forhånd.
§ 14 . Unntak fra § 9
ved oppfyllelse innen 17. november 2014 av handelskontrakter som er inngått før 16. august 2014, eller av tilknyttede kontrakter som er nødvendige for å kunne gjennomføre slike kontrakter, forutsatt at den fysiske eller juridiske personen som har til hensikt å gjennomføre kontrakten, senest ti virkedager i forveien har underrettet Utenriksdepartementet om aktiviteten eller transaksjonen som skal utføres, for varer med opprinnelse på Krim eller i Sevastopol som er stilt til rådighet for ukrainske myndigheter for undersøkelse.
Kapittel 4. Sektortiltak
§ 15 . Forbud mot eksport, import og transport av forsvarsrelaterte varer
Det er forbudt direkte eller indirekte å selge, levere, overføre eller eksportere varer og teknologi oppført i «Liste I – forsvarsrelaterte varer» i vedlegg I til forskrift 19. juni 2013 nr. 718 om eksport av forsvarsmateriell, flerbruksvarer, teknologi og tjenester til Russland, enten disse har sin opprinnelse i Norge eller ikke. Det er også forbudt å importere, kjøpe eller transportere slike varer og teknologi fra Russland.
§ 16 . Forbud mot eksport av flerbruksvarer og flerbruksteknologi
Det er forbudt direkte eller indirekte å selge, levere, overføre eller eksportere flerbruksvarer og flerbruksteknologi oppført i «Liste II – flerbruksvarer» i vedlegg II til forskrift 19. juni 2013 nr. 718 om eksport av forsvarsmateriell, flerbruksvarer, teknologi og tjenester, enten disse har sin opprinnelse i Norge eller ikke, til fysiske eller juridiske personer i Russland eller til bruk i Russland, dersom nevnte produkter helt eller delvis er eller kan være beregnet til militær bruk eller en militær sluttbruker. Dersom sluttbrukeren er det russiske militæret, skal alle flerbruksvarer og -teknologi som anskaffes av dette, anses å være beregnet til militær bruk.
Når Utenriksdepartementet treffer beslutning om søknader om tillatelser, skal de ikke gi eksporttillatelse til fysiske eller juridiske personer i Russland eller til bruk i Russland dersom departementet har rimelig grunn til å anta at sluttbrukeren kan være militær, eller at varene kan være beregnet på militær sluttbruk. Utenriksdepartementet kan gi tillatelse dersom eksporten gjelder oppfyllelse av en forpliktelse i henhold til en kontrakt eller avtale inngått før 16. august 2014.
§ 17 . Forbud mot eksport av visse teknologier til bruk i oljeindustrien
Det kreves forhåndstillatelse til direkte eller indirekte salg, levering, overføring eller eksport av teknologier som oppført i vedlegg IV, enten de har sin opprinnelse i Norge eller ikke, til fysiske eller juridiske personer i Russland eller i enhver annen stat, dersom teknologien er beregnet på bruk i Russland.
Vedlegg IV omfatter visse teknologier tilpasset petroleumsindustrien, til bruk ved oljeleting og -utvinning på dypt vann, arktisk oljeleting og -utvinning eller skiferoljeprosjekter i Russland.
Eksportører skal gi Utenriksdepartementet alle relevante opplysninger som er nødvendige i forbindelse med deres søknad om eksporttillatelse.
Utenriksdepartementet skal ikke gi tillatelse til salg, levering, overføring eller eksport av teknologier oppført i vedlegg IV dersom det med sannsynlighet kan fastslås at salget, leveringen, overføringen eller eksporten av teknologiene er beregnet på prosjekter knyttet til oljeleting og -utvinning på dypt vann, arktisk oljeleting og -utvinning eller skiferoljeprosjekter i Russland. Utenriksdepartementet kan gi tillatelse dersom eksporten gjelder oppfyllelse av en forpliktelse i henhold til en kontrakt eller avtale inngått før 16. august 2014.
Dersom det med sannsynlighet kan fastslås at en allerede innvilget eksporttillatelse er beregnet på prosjekter som nevnt i fjerde ledd, kan Utenriksdepartementet oppheve, suspendere, endre eller tilbakekalle tillatelsen.
§ 18 . Restriksjoner på faglig bistand og finansiering
direkte eller indirekte å gi faglig bistand knyttet til varer og teknologi som er oppført på «Liste I – forsvarsrelaterte varer» i vedlegg I til forskrift 19. juni 2013 nr. 718 om eksport av forsvarsmateriell, flerbruksvarer, teknologi og tjenester, eller knyttet til levering, produksjon, vedlikehold eller bruk av varer som er oppført på denne listen, til fysiske eller juridiske personer i Russland eller til bruk i Russland, direkte eller indirekte å yte finansiering eller finansiell bistand knyttet til varer og teknologi oppført «Liste I – forsvarsrelaterte varer» i vedlegg I til forskrift 19. juni 2013 nr. 718 om eksport av forsvarsmateriell, flerbruksvarer, teknologi og tjenester, herunder særlig tilskudd, lån og eksportkredittforsikring eller -garanti, til salg, levering, overføring eller eksport av slike produkter, eller til yting av tilknyttet faglig bistand til fysiske eller juridiske personer i Russland eller til bruk i Russland, direkte eller indirekte å yte faglig bistand eller formidlingstjenester knyttet til «Liste II – flerbruksvarer» i vedlegg II til forskrift 19. juni 2013 nr. 718 om eksport av forsvarsmateriell, flerbruksvarer, teknologi og tjenester eller knyttet til levering, produksjon, vedlikehold og bruk av slike varer eller slik teknologi, til fysiske eller juridiske personer i Russland eller til bruk i Russland, dersom nevnte produkter helt eller delvis er eller kan være beregnet på militær bruk eller en militær sluttbruker, direkte eller indirekte å yte finansiering eller finansiell bistand knyttet til «Liste II – flerbruksvarer» i vedlegg II til forskrift 19. juni 2013 nr. 718 om eksport av forsvarsmateriell, flerbruksvarer, teknologi og tjenester, herunder særlig tilskudd, lån og eksportkredittforsikring, til salg, levering, overføring eller eksport av slike produkter, eller til yting av tilknyttet faglig bistand til fysiske eller juridiske personer i Russland eller til bruk i Russland, dersom nevnte produkter helt eller delvis er eller kan være beregnet på militær bruk eller en militær sluttbruker.
Forbudene i første ledd berører ikke oppfyllelse av en forpliktelse i henhold til en kontrakt eller avtale inngått før 16. august 2014, eller bistand som er nødvendig for å for å opprettholde og sikre eksisterende kapasiteter i Norge.
yting av faglig bistand eller formidlingstjenester knyttet til teknologier oppført i vedlegg IV og levering, produksjon, vedlikehold og bruk av disse produktene, direkte eller indirekte til fysiske eller juridiske personer i Russland eller, dersom slik bistand gjelder teknologier til bruk i Russland, til personer, enheter eller organer i andre stater, finansiering eller finansiell bistand knyttet til teknologier oppført i vedlegg IV, herunder særlig tilskudd, lån og eksportkredittforsikring, til salg, levering, overføring eller eksport av disse teknologiene, eller yting av tilknyttet faglig bistand, direkte eller indirekte til fysiske eller juridiske personer i Russland eller, dersom slik bistand gjelder teknologier til bruk i Russland, til personer, enheter eller organer i andre stater.
Tillatelser etter tredje ledd kan ikke gis dersom det med sannsynlighet kan fastslås at bistanden er knyttet til oppfyllelse av forpliktelser i henhold til kontrakt eller avtale inngått etter 15. august 2014 vedrørende teknologi til bruk i prosjekter som gjelder oljeleting og -utvinning på dypt vann, arktisk oljeleting og -utvinning eller skiferoljeprosjekter i Russland.
§ 19 . Forbud mot handel med enkelte verdipapirer mv.
en større kredittinstitusjon eller annen større institusjon med uttrykkelig mandat til å fremme konkurranseevnen og variasjonen i den russiske økonomien og å oppmuntre til investeringer, etablert i Russland med over 50 % offentlig eierskap eller kontroll per 1. august 2014 som oppført i vedlegg V, eller en juridisk person etablert utenfor Norge som er mer enn 50 % eid av en juridisk person oppført i vedlegg V, eller en juridisk person som handler på vegne av eller på instruks fra en juridisk person som nevnt i bokstav b i dette ledd eller oppført i vedlegg V.
Kapittel 5. Avsluttende bestemmelser
§ 20 . Omgåelser
Det er forbudt forsettlig å delta i aktiviteter som har som formål eller virkning å omgå forbudene i denne forskrift.
§ 21 . Dispensasjon
Utenriksdepartementet kan i særskilte tilfeller dispensere fra forskriften dersom den får en klart utilsiktet virkning, og forutsatt at det ikke strider mot Norges folkerettslige forpliktelser eller hensynene bak de restriktive tiltakene.
§ 22 . Straff
Overtredelse av bestemmelser gitt i denne forskriften er straffbart i henhold til lov 27. april 2001 nr. 14 om iverksetjing av internasjonale, ikkje-militære tiltak i form av avbrot eller avgrensing av økonomisk eller anna samkvem med tredjestatar eller rørsler § 3.
§ 23 . Endring av forskriften
Utenriksdepartementet kan endre, suspendere og oppheve forskriften.
§ 24 . Ikrafttredelse
Denne forskrift trer i kraft straks. Fra samme tid oppheves forskrift 21. mars 2014 nr. 301 om restriktive tiltak vedrørende handlinger som undergraver eller truer Ukrainas territorielle integritet, suverenitet og uavhengighet.

As speaker of the Verkhovna Rada of Crimea, Konstantinov played a relevant role in the decisions taken by the Verkhovna Rada of Crimea concerning the 'referendum' against the territorial integrity of Ukraine and called on voters to cast votes in favour of Crimean Independence.

3. Rustam Ilmirovich Temirgaliev
d.o.b. 15.08.1976
As Deputy Chairman of the Council of Ministers of Crimea, Temirgaliev played a relevant role in the decisions taken by the Verkhovna Rada concerning the «referendum» against territorial integrity of Ukraine. He lobbied actively for integration of Crimea into the Russian Federation.

4. Deniz Valentinovich Berezovskiy
d.o.b. 15.07.1974
Berezovskiy was appointed commander of the Ukrainian Navy on 1 March 2014 and swore an oath to the Crimean armed force, thereby breaking his oath. The Prosecutor-General's Office of Ukraine launched an investigation against him for high treason.

The Ukrainian Government has opened a criminal investigation into his alleged material and financial support to separatists.
In addition, he gave a number of public statements supporting the annexation of Crimea and the incorporation of Ukraine into Russia and notably stated in June 2014 that 'You can't incorporate the whole of Ukraine into Russia. The East (of Ukraine) maybe'.
Therefore Mr. Malofeev is acting in support of the destabilisation of Eastern Ukraine.

By buying or taking over from branches of retreating banks operating in Crimea, RNCB supported materially and financially the actions of the Russian government to integrate Crimea into the Russian Federation, thus undermining Ukraine's territorial integrity.
