Forskrift om endring i forskrift om restriktive tiltak vedrørende handlinger som undergraver eller truer Ukrainas territorielle integritet, suverenitet, uavhengighet og stabilitet

I forskrift 15. august 2014 nr. 1076 om restriktive tiltak vedrørende handlinger som undergraver eller truer Ukrainas territorielle integritet, suverenitet, uavhengighet og stabilitet gjøres følgende endringer:

enhet på Krim eller i Sevastopol : ethvert selskap som er registrert som hjemmehørende i eller har sin hovedadministrasjon eller sitt hovedforetak på Krim eller i Sevastopol, som har datterselskaper eller tilknyttede foretak under sin kontroll på Krim eller i Sevastopol, eller som har filialer eller andre enheter som driver virksomhet på Krim eller i Sevastopol.

§ 10 skal lyde:

å erverve eller utvide eksisterende eierskapsinteresser i fast eiendom på Krim eller i Sevastopol, å erverve eller utvide eksisterende eierskapsinteresser i eller kontroll over en juridisk person på Krim eller i Sevastopol, herunder full ervervelse av en slik juridisk person eller ervervelse av andeler samt andre verdipapirer som har karakter av kapitalinteresse, i en slik juridisk person, å tildele eller delta i ordninger med sikte på å tildele lån eller kreditter, eller på annen måte yte finansiering, herunder egenkapital, til en enhet på Krim eller i Sevastopol eller til et dokumentert formål om å finansiere en slik juridisk person, å opprette fellesforetak på Krim eller i Sevastopol og å inngå i fellesforetak med en enhet på Krim eller i Sevastopol, å yte investeringstjenester som er direkte knyttet til aktivitetene nevnt i bokstav a til d.

Forbudene og restriksjonene i denne bestemmelse får ikke anvendelse på legitim forretningsvirksomhet som drives med juridiske personer utenfor Krim eller Sevastopol der de tilknyttede investeringene ikke er ment for juridiske personer på Krim eller i Sevastopol.

Forbudene i første ledd berører ikke oppfyllelse av en forpliktelse i henhold til en kontrakt inngått før 11. april 2015 eller tilknyttede kontrakter som er nødvendige for å oppfylle en slik kontrakt, forutsatt at den kompetente myndighet er blitt underrettet senest fem virkedager på forhånd.

§ 11 skal lyde:

til fysiske eller juridiske personer på Krim eller i Sevastopol, eller til bruk på Krim eller i Sevastopol.

transport telekommunikasjon, energi, leting, utvinning og produksjon av olje, gass og mineralressurser.

direkte eller indirekte å yte faglig bistand eller formidlingstjenester knyttet til varer og teknologi som er oppført i vedlegg II, eller til levering, produksjon, vedlikehold og bruk av slike produkter, til fysiske eller juridiske personer på Krim eller i Sevastopol eller til bruk på Krim eller i Sevastopol, direkte eller indirekte å yte finansiering eller finansiell bistand knyttet til varer og teknologi som er oppført i vedlegg II, til fysiske eller juridiske personer på Krim eller i Sevastopol eller til bruk på Krim eller i Sevastopol.

Forbudene i første og annet ledd får, når de er knyttet til første ledd bokstav b, ikke anvendelse dersom det ikke med sannsynlighet kan fastslås at varene og teknologien eller tjenestene oppført i annet ledd skal brukes på Krim eller i Sevastopol.

Forbudene i første og annet ledd berører ikke oppfyllelse innen 12. juli 2015 av en forpliktelse i henhold til en kontrakt inngått før 11. april 2015 eller tilknyttede kontrakter som er nødvendige for å oppfylle slike kontrakter, forutsatt at Utenriksdepartementet er blitt underrettet senest fem virkedager på forhånd.

§ 12 skal lyde:

Det er forbudt å yte faglig bistand eller formidlings-, bygge- eller anleggstjenester samt ingeniørtjenester som er direkte knyttet til infrastruktur på Krim eller i Sevastopol, i sektorene nevnt i § 11 første ledd som definert på grunnlag av vedlegg II, uavhengig av varenes og teknologiens opprinnelse.

Forbudet i første ledd berører ikke oppfyllelse innen 12. juli 2015 av en forpliktelse i henhold til en kontrakt inngått før 11. april 2015 eller tilknyttede kontrakter som er nødvendige for å oppfylle en slik kontrakt.

§ 13 skal lyde:

Det er forbudt å yte tjenester direkte knyttet til turistvirksomhet på Krim eller i Sevastopol.

Det er forbudt for ethvert skip som yter cruisetjenester, å anløpe eller oppholde seg i havner på Krim-halvøya som er oppført i vedlegg III.

Forbudene i første og annet ledd gjelder ikke skip som av hensyn til sjøsikkerheten i nødssituasjoner anløper en av havnene oppført i vedlegg III. Utenriksdepartementet skal underrettes om slike havneanløp innen fem virkedager.

Forbudene i første og annet ledd berører ikke oppfyllelse av en forpliktelse i henhold til en kontrakt eller en tilknyttet kontrakt inngått før 11. april 2015 eller tilknyttede kontrakter som er nødvendige for å oppfylle slike kontrakter, forutsatt at Utenriksdepartementet er blitt underrettet senest fem virkedager på forhånd.

Ny § 13a skal lyde:

er nødvendige for offisielle formål på utenriksstasjoner eller i internasjonale organisasjoner på Krim eller i Sevastopol som har immunitet i henhold til folkeretten, er knyttet til prosjekter der de utelukkende brukes til støtte for sykehus eller andre offentlige helseinstitusjoner som yter medisinske tjenester, eller for sivile utdanningsinstitusjoner, på Krim eller i Sevastopol, eller er apparater eller utstyr til medisinsk bruk.

Utenriksdepartementet kan, på de vilkår departementet finner hensiktsmessige, gi tillatelse knyttet til aktivitetene nevnt i § 10 første ledd, forutsatt at transaksjonen gjelder vedlikehold for å ivareta eksisterende infrastrukturs sikkerhet.

Utenriksdepartementet kan, på de vilkår departementet finner hensiktsmessige, gi tillatelse knyttet til aktivitetene nevnt i § 10 første ledd og § 11 annet ledd og til varene og teknologien nevnt i § 11 første ledd samt tjenestene nevnt i § 12 dersom salget, leveringen, overføringen eller eksporten av produktene eller gjennomføringen av aktivitetene er nødvendig for omgående å hindre eller begrense en hendelse som kan få alvorlige og betydelige følger for menneskers helse og sikkerhet, herunder eksisterende infrastrukturs sikkerhet, eller for miljøet. I behørig begrunnede hastetilfeller kan salget, leveringen, overføringen eller eksporten gjennomføres uten forhåndstillatelse, forutsatt at eksportøren innen fem virkedager etter at salget, leveringen, overføringen eller eksporten har funnet sted, underretter Utenriksdepartementet og gir nærmere opplysninger om den relevante begrunnelsen for at salget, leveringen, overføringen eller eksporten har funnet sted uten forhåndstillatelse.

§ 16 annet ledd annet punktum skal lyde:

Utenriksdepartementet kan gi tillatelse dersom eksporten gjelder oppfyllelse av en forpliktelse i henhold til en kontrakt inngått før 16. august 2014 eller tilknyttede kontrakter som er nødvendige for å oppfylle en slik kontrakt.

§ 16a tredje ledd skal lyde:

Forbudene i første og annet ledd berører ikke oppfyllelse av kontrakter som er inngått før 11. oktober 2014, eller tilknyttede kontrakter som er nødvendige for å oppfylle slike kontrakter.

§ 17 overskriften og første til fjerde ledd skal lyde:

Det kreves forhåndstillatelse til direkte eller indirekte salg, levering, overføring eller eksport av produkter som oppført i vedlegg IV, enten de har sin opprinnelse i Norge eller ikke, til fysiske eller juridiske personer i Russland, herunder Russlands eksklusive økonomiske sone og kontinentalsokkel, eller i enhver annen stat, dersom produktene er beregnet på bruk i Russland, herunder Russlands eksklusive økonomiske sone og kontinentalsokkel.

oljeleting og -utvinning i vann på mer enn 150 meters dyp, oljeleting og -utvinning i havområdet nord for polarsirkelen, eller prosjekter som har potensial, ved hjelp av hydraulisk frakturering, til å produsere olje fra reserver som befinner seg i skiferformasjoner; dette gjelder ikke leting og utvinning gjennom skiferformasjoner i den hensikt å lokalisere eller utvinne olje fra andre reservoarer enn skiferreservoarer.

Eksportører skal gi Utenriksdepartementet alle relevante opplysninger som er nødvendige i forbindelse med deres søknad om eksporttillatelse.

Utenriksdepartementet skal ikke gi tillatelse til salg, levering, overføring eller eksport av produkter oppført i vedlegg IV dersom det med sannsynlighet kan fastslås at salget, leveringen, overføringen eller eksporten av produktene er beregnet på noen av de kategorier av lete- og utvinningsprosjekter som er omtalt i annet ledd. Utenriksdepartementet kan gi tillatelse dersom salget, leveringen, overføringen eller eksporten gjelder oppfyllelse av en forpliktelse i henhold til en kontrakt inngått før 16. august 2014 eller tilknyttede kontrakter som er nødvendige for å oppfylle en slik kontrakt. Utenriksdepartementet kan også gi tillatelse dersom salget, leveringen, overføringen eller eksporten av produktene er nødvendig for omgående å hindre eller begrense en hendelse som kan få alvorlige og betydelige følger for menneskers helse og sikkerhet eller for miljøet. I behørig begrunnede hastetilfeller kan salget, leveringen, overføringen eller eksporten gjennomføres uten forhåndstillatelse, forutsatt at eksportøren innen fem virkedager etter at salget, leveringen, overføringen eller eksporten har funnet sted, underretter Utenriksdepartementet og gir nærmere opplysninger om den relevante begrunnelsen for at salget, leveringen, overføringen eller eksporten har funnet sted uten forhåndstillatelse.

§ 17a skal lyde:

Forbudet i første ledd berører ikke oppfyllelse av en forpliktelse i henhold til en kontrakt eller rammeavtale inngått før 11. oktober 2014 eller tilknyttede kontrakter som er nødvendige for å oppfylle slike kontrakter.

Forbudet i første ledd gjelder ikke dersom de aktuelle tjenestene er nødvendige for omgående å hindre eller begrense en hendelse som kan få alvorlige og betydelige følger for menneskers helse og sikkerhet eller for miljøet. Tjenesteyteren skal innen fem virkedager underrette Utenriksdepartementet om enhver aktivitet som iverksettes i henhold til dette ledd, og gi nærmere opplysninger om den relevante begrunnelsen for salget, leveringen, overføringen eller eksporten.

§ 18 annet og tredje ledd skal lyde:

Forbudene i første ledd berører ikke oppfyllelse av kontrakter som er inngått før 16. august 2014, eller tilknyttede kontrakter som er nødvendige for å oppfylle slike kontrakter, eller yting av bistand som er nødvendig for å opprettholde og sikre eksisterende kapasiteter i Norge.

yting av faglig bistand eller formidlingstjenester knyttet til produkter oppført i vedlegg IV og levering, produksjon, vedlikehold og bruk av disse produktene, direkte eller indirekte til fysiske eller juridiske personer i Russland, herunder Russlands eksklusive økonomiske sone og kontinentalsokkel, eller, dersom slik bistand gjelder produkter til bruk i Russland, herunder Russlands eksklusive økonomiske sone og kontinentalsokkel, til fysiske eller juridiske personer i andre stater. finansiering eller finansiell bistand knyttet til produkter oppført i vedlegg IV, herunder særlig tilskudd, lån og eksportkredittforsikring, til salg, levering, overføring eller eksport av disse teknologiene, eller yting av tilknyttet faglig bistand, direkte eller indirekte til fysiske eller juridiske personer i Russland, herunder Russlands eksklusive økonomiske sone og kontinentalsokkel, eller, dersom slik bistand gjelder produkter til bruk i Russland, herunder Russlands eksklusive økonomiske sone og kontinentalsokkel, til fysiske eller juridiske personer i andre stater.

I behørig begrunnede hastetilfeller som nevnt i § 17 fjerde ledd kan yting av tjenester omtalt i dette ledd gjennomføres uten forhåndstillatelse, forutsatt at tjenesteyteren underretter Utenriksdepartementet innen fem virkedager etter at tjenestene er levert.

§ 19 tredje ledd skal lyde:

Forbudet gjelder ikke

lån eller kreditter som har som konkret og dokumentert formål å finansiere vareimport eller -eksport som ikke omfattes av forbud, og ikke-finansielle tjenester mellom Norge og en tredjestat, herunder utgifter til varer og tjenester fra en annen tredjestat som er nødvendige for å oppfylle eksport- eller importkontraker, eller lån som har som konkret og dokumentert formål å yte nødfinansiering med sikte på å oppfylle solvens- og likviditetskriterier for juridiske personer etablert i Norge eller EU som er mer enn 50 % eid av en juridisk person oppført i vedlegg V.

§ 19 nytt fjerde ledd skal lyde:

alle vilkår som gjelder ved slik kredittutnyttelse eller slike utbetalinger, var avtalt før 11. oktober 2014 og ikke er blitt endret på eller etter denne dato, og det før 11. oktober 2014 er fastsatt en kontraktsfestet forfallsdag for full tilbakebetaling av alle penger som er stilt til rådighet, og for oppheving av alle tilsagn, rettigheter og forpliktelser i henhold til kontrakten.

Vilkårene som gjelder ved utnyttelse av kredittmuligheten og utbetalinger som nevnt i bokstav a, skal omfatte bestemmelser om lengden på tilbakebetalingstiden for hver kredittutnyttelse eller utbetaling, gjeldende rentesats eller renteberegningsmetoden samt maksimumsbeløpet.
