I forskrift 15. desember 2006 nr. 1405 om sanksjoner og restriktive tiltak mot Nord-Korea gjøres følgende endringer:

I vedlegg A gjøres følgende endringer:

Artikkel 1 nytt nr. 16 skal lyde:

16) «tjenester i tilknytning til»: tjenester som ytes mot et honorar eller i henhold til kontrakt, av enheter som hovedsakelig er involvert i produksjon av transportable varer, samt tjenester som normalt er forbundet med produksjon av slike varer.

Ny artikkel 3c skal lyde:

Artikkel 3c

direkte eller indirekte å yte tjenester i tilknytning til gruvedrift eller tjenester i tilknytning til produksjon innenfor kjemisk industri, gruvedrift og raffinering, som nevnt i vedlegg VIII del A, til fysiske eller juridiske personer, enheter eller organer i eller til bruk i Nord-Korea, og direkte eller indirekte å yte datatjenester og tilknyttede tjenester nevnt i vedlegg VIII del B til fysiske eller juridiske personer, enheter eller organer i eller til bruk i Nord-Korea.

2. Som unntak fra forbudet i nr. 1 bokstav a) kan de kompetente myndighetene i medlemsstatene, som angitt på nettsidene oppført i vedlegg II, gi tillatelse til å yte tjenester i tilknytning til gruvedrift og tjenester i tilknytning til produksjon innenfor kjemisk industri, gruvedrift og raffinering dersom tjenestene er forutsatt benyttet utelukkende til utviklingsformål rettet direkte mot sivilbefolkningens behov eller for å fremme kjernefysisk nedrustning.

3. Forbudet i nr. 1 bokstav b) gjelder ikke yting av datatjenester og tilknyttede tjenester dersom tjenestene er forutsatt benyttet utelukkende til offisielle formål på en utenriksstasjon eller i en internasjonal organisasjon som har immunitet i Nord-Korea i henhold til folkeretten.

4. Forbudet i nr. 1 bokstav b) gjelder ikke datatjenester og tilknyttede tjenester som ytes av offentlige organer eller juridiske personer, enheter eller organer som mottar offentlig finansiering fra Unionen eller medlemsstatene for å gi bistand til utviklingsformål rettet direkte mot sivilbefolkningens behov eller for å fremme kjernefysisk nedrustning.

5. I saker som ikke omfattes av nr. 4, kan de kompetente myndighetene i medlemsstatene, som angitt på nettsidene oppført i vedlegg II, gjøre unntak fra forbudet i nr. 1 bokstav b) og gi tillatelse til å yte datatjenester og tilknyttede tjenester dersom tjenestene er forutsatt benyttet utelukkende til utviklingsformål rettet direkte mot sivilbefolkningens behov eller for å fremme kjernefysisk nedrustning.

6. Forbudene i nr. 1 gjelder ikke tjenester som ytes fram til 9. juli 2017 i henhold til kontrakter, avtaler eller forpliktelser som er inngått eller oppstod før 8. april 2017.

Artikkel 5b nr. 2 skal lyde:

å opprette et fellesforetak med eller kjøpe eller utvide en eierskapsinteresse, herunder gjennom en fullstendig overtakelse eller ved å erverve andeler eller andre verdipapirer som har karakter av kapitalinteresse, i juridiske personer, enheter eller organer nevnt i nr. 1 bokstav a)–f) som er involvert i Nord-Koreas virksomhet eller programmer for kjernefysiske våpen, ballistiske missiler eller andre masseødeleggelsesvåpen, eller i virksomhet innenfor gruvedrift, raffinering, kjemisk industri, metallurgi og metallbearbeiding, romfartsindustri eller konvensjonell våpenindustri, å yte finansiering eller finansiell bistand til juridiske personer, enheter eller organer nevnt i nr. 1 bokstav d)–f) eller å yte finansiering eller finansiell bistand med det dokumenterte formål å finansiere slike juridiske personer, enheter eller organer, å yte investeringstjenester som er direkte eller indirekte knyttet til virksomhet som nevnt i bokstav a) og b) ovenfor.
