I forskrift 30. mars 2011 nr. 338 om særlige importbetingelser for fôrvarer og næringsmidler med opprinnelse i eller eksportert fra Japan gjøres følgende endringer:

EØS-henvisningsfeltet skal lyde:

EØS-avtalen vedlegg I kap. I del 7.1 nr. 13, kap. II nr. 41 og vedlegg II kap. XII nr. 54zzzc (forordning (EU) 2016/6, som endret ved forordning (EU) 2017/2058).

§ 2 skal lyde:

EØS-avtalens vedlegg I kapittel I del 7.1 nr. 13, kap. II nr. 41 og vedlegg II kap. XII nr. 54zzzc (forordning (EU) 2016/6 som endret ved forordning (EU) 2017/2058) om særlige importbetingelser for fôrvarer og næringsmidler med opprinnelse i eller sendt fra Japan etter ulykken ved atomkraftverket i Fukushima og opphever forordning (EU) nr. 322/2014 gjelder som forskrift med de tilpasninger som følger av vedlegg I og II, protokoll 1 til avtalen og avtalen for øvrig.

Denne forskriften trer i kraft 1. desember 2017.

Nedenfor gjengis til informasjon EØS-avtalen vedlegg I kapittel I del 7.1 nr. 13, kap. II nr. 41 og vedlegg II kap. XII nr. 54zzzc (forordning (EU) 2016/6, som endret ved forordning (EU) 2017/2058) med de endringer og tillegg som følger av EØS-tilpasningen av rettsakten i samsvar med vedlegg I og II til EØS-avtalen.

Artikkel 1 første avsnitt skal lyde:

Artikkel 5 første ledd skal lyde:

Each consignment of feed and food referred to and falling under the CN codes mentioned in Annex II and the compound feed or food containing more than 50 % of these products, originating in or consigned from Japan shall be accompanied by a valid declaration drawn up and signed in accordance with Article 6. ◄ M1

Artikkel 5 tredje ledd bokstav c skal lyde:

the product is consigned from but does not originate in one of the prefectures listed in Annex II, for which the sampling and analysis of this product is required and has not been exposed to radioactivity during transiting or processing; or

4. Fish and fishery products referred to in Annex II, caught or harvested in the coastal waters of the prefectures of Fukushima, Gunma, Tochigi, Miyagi, Ibaraki, Chiba or Iwate shall be accompanied by a declaration referred to paragraph 1 and by an analytical report containing the results of sampling and analysis, irrespective of where such products are landed. ◄ M1

For dried mushrooms a reconstitution factor of 5 is of application.

For tea, the maximum level applies to the infusion brewed from unfermented tea leaves. The processing factor for dried tea is 50, and therefore a maximum level of 500 Bq/kg on dried tea leaves ensures that the level in the brewed tea does not exceed the maximum level of 10 Bq/kg.

2 In order to ensure consistency with maximum levels currently applied in Japan, these values replace on a provisional basis the values laid down in Regulation (Euratom) No 2016/52.
