Forskrift om endring i forskrift om restriktive tiltak vedrørende handlinger som undergraver eller truer Ukrainas territorielle integritet, suverenitet, uavhengighet og stabilitet

I forskrift 15. august 2014 nr. 1076 om restriktive tiltak vedrørende handlinger som undergraver eller truer Ukrainas territorielle integritet, suverenitet, uavhengighet og stabilitet gjøres følgende endringer:

partnerland for import av petroleumsprodukter : et land, som oppført i vedlegg LI, som anvender restriktive tiltak på import av råolje og petroleumsprodukter som i det vesentlige tilsvarer de som er fastsatt i § 17j.

I § 8ca gjøres følgende endringer:

Overskriften i § 8ca skal lyde:

§ 8ca . Forbud mot transaksjoner med juridiske personer oppført i vedlegg XIX mv., og forbud mot å inneha stillinger i visse styrende organer

Første ledd skal lyde:

juridiske personer som er etablert i Russland og er under offentlig kontroll, eller der det offentlige eier over 50 %, eller der Russland, Russlands regjering eller Russlands sentralbank har rett til utbytte, eller der Russland, Russlands regjering eller Russlands sentralbank har andre betydelige økonomiske forbindelser, som oppført i vedlegg XIX, eller juridiske personer etablert utenfor Norge eller EU hvis eiendomsrettigheter direkte eller indirekte er mer enn 50 % eid av en juridisk person oppført i vedlegg XIX, eller juridiske personer som handler på vegne av eller på instruks fra en juridisk person nevnt i bokstav a eller b i dette leddet.

Tredje ledd skal lyde:

juridiske personer som er etablert i Russland og er under offentlig kontroll, eller der det offentlige eier over 50 %, eller der Russland, Russlands regjering eller Russlands sentralbank har rett til utbytte, eller der Russland, Russlands regjering eller Russlands sentralbank har andre betydelige økonomiske forbindelser, juridiske personer som er etablert i Russland, hvis eiendomsrettigheter direkte eller indirekte er mer enn 50 % eid av en juridisk person omtalt i bokstav a, eller juridiske personer som er etablert i Russland og handler på vegne av eller på instruks fra en juridisk person nevnt i bokstav a eller b.

Dette forbudet gjelder ikke juridiske personer nevnt i første ledd. For disse gjelder andre ledd.

Trettende ledd skal lyde:

kompetente myndigheter, i Norge eller EU, har satt en slik juridisk person under administrasjon av en offentlig tilsynsmyndighet eller pålagt den juridiske personen et lignende offentlig brannmurtiltak, eller et tilsvarende brannmurtiltak er godkjent av kompetente myndigheter i Norge eller EU for å sikre at de juridiske personene fortsetter å fungere og at de restriktive tiltakene overholdes.

transaksjoner knyttet til energiprosjekter utenfor Russland der en juridisk person oppført i vedlegg XIX er en mindretallsaksjeeier,

Nåværende fjortende ledd blir femtende ledd. Femtende ledd skal lyde:

Som unntak fra første ledd kan Direktoratet for eksportkontroll og sanksjoner gi tillatelse på de vilkårene direktoratet finner hensiktsmessige, til transaksjoner som er strengt nødvendige for avhending og tilbaketrekking av de juridiske personene nevnt i første ledd eller deres datterselskaper i Norge eller EU innen 6. mars 2026 fra juridiske personer som er etablert i Norge eller EU.

I § 8cd skal andre ledd lyde:

Det er forbudt å delta, direkte eller indirekte, i transaksjoner med juridiske personer etablert utenfor Russland som oppført i vedlegg XLIV. Vedlegg XLIV omfatter juridiske personer som er etablert utenfor Russland, og som bruker SPFS eller tilsvarende spesialiserte finansielle meldingstjenester som er opprettet av Russlands sentralbank eller den russiske staten.

§ 8ce skal lyde:

er en kreditt- eller finansinstitusjon eller en enhet som yter tjenester knyttet til kryptoeiendeler, og som vesentlig motvirker formålet med forbudene i denne forskriften, som oppført i del A i vedlegg XLV til denne forskriften, er en kreditt- eller finansinstitusjon eller en enhet som yter tjenester knyttet til kryptoeiendeler som støtter Russlands angrepskrig mot Ukraina, herunder ved å behandle transaksjoner eller gi eksportfinansiering til handelstransaksjoner som motvirker formålet med denne forskriften, som oppført i del B i vedlegg XLV til denne forskriften, ikke er en kreditt- eller finansinstitusjon eller en enhet som yter tjenester knyttet til kryptoeiendeler, og som vesentlig motvirker formålet med forbudene fastsatt i § 17j, § 17k og § 19ac i denne forskriften, som oppført i del C i vedlegg XLV til denne forskriften.

Forbudet i første ledd gjelder også juridiske personer som handler på vegne av eller på instruks fra en enhet nevnt i første ledd bokstav a, b eller c.

nødvendige for eksport, salg, levering, overføring eller transport av legemidler, medisinske produkter, landbruksprodukter eller matvarer, herunder hvete og gjødsel, som det er tillatt å eksportere, selge, levere, overføre eller transportere til Russland i henhold til denne forskriften, strengt nødvendige for å sikre tilgang til rettslige, administrative eller voldgiftsmessige prosedyrer i Norge eller en medlemsstat i EU, eller for anerkjennelse eller fullbyrdelse av en dom eller en voldgiftskjennelse avsagt i Norge eller en medlemsstat i EU, forutsatt at slike transaksjoner er i samsvar med formålene i denne forskriften, eller nødvendige for humanitære formål, som å yte eller legge til rette for yting av bistand, herunder medisinsk utstyr, matvarer eller forflytning av humanitære hjelpearbeidere og tilhørende bistand, eller evakuering.

I § 8cf tredje ledd gjøres følgende endringer:

transaksjoner som gjelder kjøp, import eller overføring av råolje og petroleumsprodukter oppført i vedlegg XXV som transporteres til sjøs, dersom disse varene har opprinnelse i et tredjeland og kun lastes i, sendes fra eller i transitt gjennom Russland, forutsatt at varene verken har russisk opprinnelse eller eier,

transaksjoner som er nødvendige for etablering, drift, vedlikehold, forsyning og opparbeiding av brensel samt sikkerhet knyttet til sivile kjernefysiske kapasiteter, og fortsatt design, oppføring og idriftsettelse som kreves for å ferdigstille sivile atomanlegg, eller

transaksjoner for kjøp, import eller overføring av kull som hører inn under KN-kode 2701 hvis det har opprinnelse i et tredjeland og kun lastes i, sendes fra eller er i transitt gjennom Russland, forutsatt at varene verken har russisk opprinnelse eller eier.

I § 8cf fjerde ledd gjøres følgende endringer:

fysiske personer, som av private grunner reiser til eller fra Russland, eller for medlemmer av deres nærmeste familie som reiser sammen med dem,

kjøp, import eller transport av legemidler, medisinske produkter, landbruksprodukter og matvarer som det er tillatt å importere, kjøpe og transportere i henhold til denne forskriften, eller

etablering, drift, vedlikehold, forsyning og opparbeiding av brensel samt sikkerhet knyttet til sivile kjernefysiske kapasiteter, og fortsatt design, bygging og idriftsettelse som kreves for å ferdigstille sivile atomanlegg.

Ny § 8cg skal lyde:

Det er forbudt direkte eller indirekte å delta i transaksjoner i forbindelse med naturgassrørledningene Nord Stream og Nord Stream 2, med hensyn til ferdigstillelse, drift, vedlikehold eller bruk av rørledningene. I tillegg er det forbudt direkte eller indirekte å delta i transaksjoner i forbindelse med finansiering av ferdigstillelse, drift eller bruk av rørledningene.

Forbudene i første ledd gjelder ikke transaksjoner som er strengt nødvendige for omgående hindring eller begrensning av en hendelse som kan få alvorlige og betydelige følger for menneskers helse og sikkerhet, sjøtransport eller miljøet, eller som respons ved naturkatastrofer.

avvikling eller omstrukturering av juridiske personer i forbindelse med naturgassrørledningene Nord Stream og Nord Stream 2 der dette er nødvendig for å sikre at naturgassrørledningene Nord Stream og Nord Stream 2 ikke vil bli brukt, å kreve kompensasjon, tilbakebetalinger eller andre midler fra fysiske eller juridiske personer i forbindelse med naturgassrørledningene Nord Stream og Nord Stream 2, å foreta og motta betalinger eller tilbakebetalinger som har forfalt eller vil forfalle i forbindelse med rettsavgjørelser, finansiering, forsikring, garantier eller andre kontrakter eller avtaler i forbindelse med naturgassrørledningene Nord Stream og Nord Stream 2 som ble inngått før 29. oktober 2025, et forlik, eller en rettsak eller voldgiftssak i forbindelse med naturgassrørledningene Nord Stream og Nord Stream 2, regelmessige vedlikeholdstjenester som er strengt nødvendige for å forhindre miljø- og sikkerhetsrisikoer eller negativ innvirkning på fiskerisektoren.

Operatører skal underrette Direktoratet for eksportkontroll og sanksjoner om enhver transaksjon som er gjennomført i henhold til andre ledd innen to uker etter at den er gjennomført.

Ny § 8ch skal lyde:

Det russiske fond for direkteinvesteringer, juridiske personer som eies eller kontrolleres av Det russiske fond for direkteinvesteringer, juridiske personer etablert utenfor Norge eller EU som en enhet nevnt i bokstav a eller b direkte eller indirekte har foretatt en betydelig investering i, som oppført i vedlegg XLIX, juridiske personer etablert utenfor Norge eller EU som leverer investeringstjenester eller andre finansielle tjenester til en enhet omtalt i bokstav a, b eller c, som oppført i vedlegg L, juridiske personer som handler på vegne av eller på instruks fra en enhet nevnt i bokstav a, b, c eller d.

Som unntak fra bestemmelsene i første ledd kan Direktoratet for eksportkontroll og sanksjoner gi tillatelse til transaksjoner som er strengt nødvendige for kjøp, import eller transport av legemidler og medisinske produkter som det er tillatt å importere, kjøpe og transportere i henhold til denne forskriften.

Som unntak fra bestemmelsene i første ledd kan Direktoratet for eksportkontroll og sanksjoner fram til 31. desember 2026, på de vilkårene direktoratet finner hensiktsmessige, gi tillatelse til transaksjoner som er strengt nødvendige for avhending og tilbaketrekking fra Russland eller avvikling av forretningsvirksomhet i Russland.

§ 8k skal lyde:

Det er forbudt direkte eller indirekte å delta i transaksjoner med juridiske personer oppført i vedlegg XV eller med juridiske personer etablert i Russland hvis eiendomsrettigheter direkte eller indirekte er mer enn 50 % eid av en enhet oppført i vedlegg XV.

som er nødvendige for drift av Norges eller EUs diplomatiske og konsulære representasjoner i Russland, herunder delegasjoner, ambassader og utenriksstasjoner, eller av internasjonale organisasjoner i Russland som har immunitet i henhold til folkeretten, som er foretatt av statsborgere i Norge eller EUs medlemsland, som er bosatt i Russland og var det før 24. februar 2022.

Som unntak fra bestemmelsene i første ledd kan Direktoratet for eksportkontroll og sanksjoner, på de vilkårene direktoratet finner hensiktsmessige, gi tillatelse til transaksjoner som er strengt nødvendige for avhendelser fra Russland eller avvikling av forretningsvirksomhet i Russland.

betaling for varer som hører inn under KN 3402 90, oppfyllelse av kontrakter innen 1. januar 2028 eller kontraktenes utløpsdato, avhengig av hva som inntreffer først, såfremt kontraktene er inngått før 11. april 2025.

Forbudet i første ledd gjelder for hver av de juridiske personene som er oppført i vedlegg XV, fra og med den datoen som er oppført for dem i det nevnte vedlegget. Forbudet gjelder fra og med den samme datoen for juridiske personer som er etablert i Russland, og hvis eiendomsrettigheter direkte eller indirekte er mer enn 50 % eid av en enhet oppført i vedlegg XV.

I § 12 fjerde ledd gjøres følgende endringer:

Det er forbudt direkte eller indirekte å selge, levere, overføre, eksportere eller stille til rådighet programvare for foretaksledelse og programvare for industridesign og produksjon som oppført i vedlegg XXXIXA til juridiske personer på Krim eller i Sevastopol.

I § 14d fjerde ledd gjøres følgende endringer:

Det er forbudt direkte eller indirekte å selge, levere, overføre, eksportere eller stille til rådighet programvare for foretaksledelse og programvare for industridesign og produksjon som oppført i vedlegg XXXIXA til juridiske personer i de angitte territoriene.

§ 15 skal lyde:

direkte eller indirekte å selge, levere, overføre eller eksportere varer og teknologi som er oppført på «Liste I – forsvarsrelaterte varer» i vedlegg I til forskrift 19. juni 2013 nr. 718 om eksport av forsvarsmateriell, flerbruksvarer, teknologi og tjenester, uavhengig om de har opprinnelse i Norge eller ikke, til fysiske eller juridiske personer i Russland eller til bruk i Russland, direkte eller indirekte å yte faglig bistand, formidlingstjenester eller andre tjenester knyttet til militære aktiviteter eller til varer og teknologi som er oppført på «Liste I – forsvarsrelaterte varer» i vedlegg I til forskrift 19. juni 2013 nr. 718 om eksport av forsvarsmateriell, flerbruksvarer, teknologi og tjenester, eller knyttet til levering, produksjon, vedlikehold og bruk av varer oppført på nevnte liste, til fysiske eller juridiske personer i Russland eller til bruk i Russland, finansiering eller finansiell bistand knyttet til militære aktiviteter eller til salg, levering, overføring eller eksport av varene og teknologien oppført på «Liste I – forsvarsrelaterte varer» i vedlegg I til forskrift 19. juni 2013 nr. 718 om eksport av forsvarsmateriell, flerbruksvarer, teknologi og tjenester, eller levering av tilknyttet faglig bistand, formidlingstjenester eller andre tjenester til fysiske eller juridiske personer i Russland eller til bruk i Russland, direkte eller indirekte å kjøpe, importere eller transportere varene og teknologien oppført på «Liste I – forsvarsrelaterte varer» i vedlegg I til forskrift 19. juni 2013 nr. 718 om eksport av forsvarsmateriell, flerbruksvarer, teknologi og tjenester til Norge dersom de har opprinnelse i Russland eller eksporteres fra Russland.

import, kjøp eller transport knyttet til levering av reservedeler og tjenester som er nødvendige for vedlikehold av og sikkerhet for eksisterende kapasiteter i Norge eller EU, eller oppfyllelse av kontrakter inngått før 16. august 2014 eller tilknyttede kontrakter som er nødvendige for å oppfylle slike kontrakter, eller salg, levering, overføring eller eksport av, eller yting av tilknyttet finansiering eller finansiell bistand, faglig bistand, formidlingstjenester eller andre tjenester for reservedeler og tjenester som er nødvendige for vedlikehold av, reparasjon av og sikkerhet for eksisterende kapasiteter i Norge eller EU.

salg, levering, overføring eller eksport, eller yting av tilknyttet finansiering eller finansiell bistand, faglig bistand, formidlingstjenester eller andre tjenester, samt import, kjøp eller transport av hydrazin (CAS 302 01 2) i konsentrasjoner på minst 70 %, forutsatt at mengden hydrazin beregnes i samsvar med oppskytningen eller oppskytningene eller satellittene stoffet er framstilt for, og ikke overstiger en samlet mengde på 800 kg for hver enkelt oppskytning eller satellitt, import, kjøp eller transport av usymmetrisk dimetylhydrazin (CAS 57 14 7), salg, levering, overføring eller eksport samt import, kjøp eller transport av monometylhydrazin (CAS 60 34 4), forutsatt at mengden monometylhydrazin beregnes i samsvar med oppskytningen eller oppskytningene eller satellittene stoffet er framstilt for, i den utstrekning stoffene nevnt i bokstav a, b og c er beregnet på bruk i oppskytningsutstyr som benyttes av europeiske leverandører av oppskytningstjenester, ved oppskytninger knyttet til europeiske romprogrammer eller som drivstoff til satellitter framstilt av europeiske produsenter.

tester og flyging av ExoMars Descent Module innenfor rammen av ExoMars 2020-oppdraget, i en mengde beregnet i samsvar med behovene for hver fase av oppdraget, som samlet ikke overstiger 5 000 kg for hele varigheten av oppdraget, eller flyging av ExoMars Carrier innenfor rammen av ExoMars 2020-oppdraget, i en mengde beregnet i samsvar med behovene til flygingen, som samlet ikke overstiger 300 kg.

Virksomheten nevnt i tredje og fjerde ledd krever forhåndstillatelse av Direktoratet for eksportkontroll og sanksjoner. De som søker om forhåndstillatelse, skal gi Direktoratet for eksportkontroll og sanksjoner alle relevante opplysninger som er nødvendige.

direkte eller indirekte salg, levering, overføring eller eksport av varer oppført i vedlegg IV til fysiske eller juridiske personer i Russland, herunder Russlands eksklusive økonomiske sone og kontinentalsokkel, eller, dersom nevnte salg, levering, overføring eller eksport gjelder varer til bruk i Russland, herunder Russlands eksklusive økonomiske sone og kontinentalsokkel, til fysiske eller juridiske personer i andre stater, yting av faglig bistand, formidlingstjenester eller andre tjenester knyttet til varer oppført i vedlegg IV og direkte eller indirekte levering, produksjon, vedlikehold og bruk av disse varene til fysiske eller juridiske personer i Russland, herunder Russlands eksklusive økonomiske sone og kontinentalsokkel, eller, dersom slik bistand gjelder produkter til bruk i Russland, herunder Russlands eksklusive økonomiske sone og kontinentalsokkel, til fysiske eller juridiske personer i andre stater, yting av finansiering eller finansiell bistand knyttet til varer oppført i vedlegg IV for salg, levering, overføring eller eksport av disse varene eller direkte eller indirekte yting av tilknyttet faglig bistand, formidlingstjenester eller andre tjenester til fysiske eller juridiske personer i Russland, herunder Russlands eksklusive økonomiske sone og kontinentalsokkel, eller, dersom slik bistand gjelder varer til bruk i Russland, herunder Russlands eksklusive økonomiske sone og kontinentalsokkel, til fysiske eller juridiske personer i andre stater.

I § 16 gjøres følgende endringer:

Den innledende teksten i niende ledd skal lyde:

Når Direktoratet for eksportkontroll og sanksjoner treffer beslutning om søknader om tillatelser i samsvar med sjette og åttende ledd, skal direktoratet ikke gi tillatelse dersom det har rimelig grunn til å anta at

Tiende ledd skal lyde:

Direktoratet for eksportkontroll og sanksjoner kan oppheve, suspendere, endre eller tilbakekalle en tillatelse gitt i medhold av fjerde eller femte ledd, dersom direktoratet finner at slik oppheving, suspensjon, endring eller tilbakekalling er nødvendig for en effektiv gjennomføring av denne forskriften.

I § 16a gjøres følgende endringer:

Tredje ledd skal lyde:

Dersom Direktoratet for eksportkontroll og sanksjoner har informasjon om at varer oppført i vedlegg IX som skal eksporteres til andre land enn Russland helt eller delvis er eller kan være beregnet til fysiske eller juridiske personer i Russland eller til bruk i Russland, kan direktoratet informere eksportørene og kreve tillatelse før eksport av de aktuelle varene kan finne sted, uten at det berører forbudet mot indirekte eksport i første ledd og krav om lisens i forskrift 19. juni 2013 nr. 718 om eksport av forsvarsmateriell, flerbruksvarer, teknologi og tjenester.

Nåværende tredje ledd blir fjerde ledd.

Femte ledd skal lyde:

humanitære formål, helsekriser, omgående hindring eller begrensning av en hendelse som sannsynligvis vil få alvorlige og betydelige følger for menneskers helse og sikkerhet og miljø, eller som respons ved naturkatastrofer, eller medisinske eller farmasøytiske formål, forutsatt at de ikke er oppført i vedlegg XL.

Eksportøren skal oppgi i tolldeklarasjonen at produktene eksporteres i henhold til det gjeldende unntaket fastsatt i dette leddet, og skal underrette Direktoratet for eksportkontroll og sanksjoner, om når det relevante unntaket anvendes første gang per mottaker i Russland.

Sjette ledd skal lyde:

Forbudet i andre ledd får ikke anvendelse på transitt via Russlands territorium av varer og teknologi som kan bidra til å øke Russlands militære og teknologiske styrke, eller til å utvikle Russlands forsvars- og sikkerhetssektor, som oppført i vedlegg IX, ment til bruk for formålene fastsatt i femte ledd.

Nåværende sjette ledd blir syvende ledd. Den innledende teksten i syvende ledd skal lyde:

Direktoratet for eksportkontroll og sanksjoner kan gi unntak fra første og fjerde ledd ved å tillate salg, eksport, levering eller overføring av varer og teknologi oppført i vedlegg IX eller yting av tilknyttet faglig eller finansiell bistand til ikke-militær bruk og til en ikke-militær sluttbruker, etter å ha slått fast at slike varer eller slik teknologi eller den tilknyttede faglige eller finansielle bistanden er

Åttende ledd skal lyde:

Som unntak fra andre ledd kan Direktoratet for eksportkontroll og sanksjoner gi tillatelse til transitt via Russlands territorium av varer og teknologi som kan bidra til å øke Russlands militære og teknologiske styrke, eller til å utvikle Russlands forsvars- og sikkerhetssektor, som oppført i vedlegg IX, etter å ha slått fast at varene eller teknologien er ment til bruk for formålene fastsatt i syvende ledd bokstav b, c, d, h og l.

Niende ledd skal lyde:

Som unntak fra første og fjerde ledd, kan Direktoratet for eksportkontroll og sanksjoner gi tillatelse til salg, levering, overføring eller eksport av varer og teknologi som nevnt i første ledd eller yting av tilknyttet faglig eller finansiell bistand til ikke-militær bruk og til en ikke-militær sluttbruker, etter å ha slått fast at slike varer eller slik teknologi eller den tilknyttede faglige eller finansielle bistanden er i henhold til kontrakter inngått før 19. mars 2022 eller tilknyttede kontrakter som er nødvendige for å kunne oppfylle en slik kontrakt, forutsatt at tillatelsen søkes om før 20. mai 2022.

Nåværende niende ledd blir tiende ledd. Den innledende teksten i tiende ledd skal lyde:

Når Direktoratet for eksportkontroll og sanksjoner treffer beslutning om søknader om tillatelser i samsvar med syvende eller niende ledd, skal Direktoratet for eksportkontroll og sanksjoner ikke gi tillatelse dersom det har rimelig grunn til å anta at

Ellevte ledd skal lyde:

Direktoratet for eksportkontroll og sanksjoner kan oppheve, suspendere, endre eller tilbakekalle en tillatelse gitt i medhold av syvende eller niende ledd, dersom Direktoratet for eksportkontroll og sanksjoner finner at slik oppheving, suspensjon, endring eller tilbakekalling er nødvendig for en effektiv gjennomføring av denne forskriften.

§ 16c første ledd skal lyde:

Melding til Direktoratet for eksportkontroll og sanksjoner som nevnt i § 16 tredje ledd og § 16a fjerde ledd skal, dersom det er mulig, oversendes elektronisk på skjemaer som inneholder minst alle elementene i malene fastsatt i vedlegg X og i den rekkefølgen som er fastsatt der.

§ 17a fjerde ledd skal lyde:

Som unntak fra første ledd bokstav b kan Direktoratet for eksportkontroll og sanksjoner på de vilkår Direktoratet for eksportkontroll og sanksjoner finner hensiktsmessige tillate enhver virksomhet nevnt i første ledd bokstav b, etter å ha slått fast at virksomheten i overensstemmelse med § 8ca fjortende ledd bokstav b er nødvendig for å sikre drift av et offshore dypvannsgassprosjekt i Middelhavet, der en juridisk person som er oppført i vedlegg XIX, var en mindretallsaksjeeier før 31. oktober 2017 og fortsatt er det. Slik tillatelse kan kun gis hvis prosjektet alene eller sammen med andre kontrolleres eller drives av en juridisk person som er etablert eller stiftet i henhold til Norges eller en EU-medlemsstats lovgivning.

I § 17ad skal nytt femte ledd lyde:

Som unntak fra forbudene i første og andre ledd kan Direktoratet for eksportkontroll og sanksjoner, eller den kompetente myndigheten i en EU-medlemsstat som ikke er direkte koblet til det sammenkoblede naturgassystemet i en annen medlemsstat, og som mottok den første kommersielle leveransen av sin første langsiktige naturgassforsyningskontrakt etter 29. oktober 2025, tillate kjøp, import eller overføring av flytende naturgass som hører inn under KN-kode 2711 11 00, og som har opprinnelse i Russland eller er eksportert fra Russland, etter å ha slått fast at kjøpet, importen eller overføringen anvendes for å sikre energiforsyningen.

Som unntak fra første og andre ledd kan Direktoratet for eksportkontroll og sanksjoner gi tillatelse til import av varer som hører inn under KN-kode 9026, 9027 og 9031, som oppført i vedlegg XXI, eller yting av tilknyttet faglig eller finansiell bistand, med henblikk på vedlikehold, reparasjon eller periodisk sertifisering av målepunkter for primær og sekundær råolje på Druzjba-rørledningen inn i EU, på de vilkårene Direktoratet for eksportkontroll og sanksjoner finner hensiktsmessig, etter å ha slått fast at varene er strengt nødvendige for å yte tjenester for å sikre uavbrutt forsyning av råolje gjennom Druzjba-rørledningen fra Russland, som nevnt i § 17j tredje ledd bokstav d, og at de vil bli eksportert i henhold til § 17i syttende ledd i et tidsrom som er strengt nødvendig for vedlikehold, reparasjon eller periodisk sertifisering av Druzjba-rørledningen

Når Direktoratet for eksportkontroll og sanksjoner treffer beslutning om søknader om tillatelser omhandlet i tiende, ellevte, tolvte, trettende, fjortende og femtende ledd, skal Direktoratet for eksportkontroll og sanksjoner ikke gi eksporttillatelse til fysiske eller juridiske personer i Russland eller til bruk i Russland, dersom Direktoratet for eksportkontroll og sanksjoner har rimelig grunn til å anta at varene kan være beregnet på militær sluttbruk.

§ 17j fjerde ledd skal lyde:

Anvendelse av unntaket i tredje ledd bokstav d skal opphøre 23. juni 2023 i Tyskland og Polen. Anvendelse av unntaket i tredje ledd bokstav d skal opphøre 1. juli 2025 i Tsjekkia.

Ny § 17ja skal lyde:

Fra og med 2. mai 2026 er det forbudt direkte eller indirekte å kjøpe, importere eller overføre petroleumsprodukter som hører inn under KN-kode 2710 til Norge, som er framstilt i et tredjeland av råolje som hører inn under KN-kode 2709 00 og har opprinnelse i Russland. Importører skal, på importtidspunktet, framlegge dokumentasjon på opprinnelsesland for råoljen brukt til raffinering av produktet i et tredjeland, med mindre produktet er importert fra EU eller et partnerland oppført i vedlegg LI. Petroleumsprodukter som er importert fra tredjeland som var nettoeksportører av råolje i det foregående kalenderåret, skal anses som framstilt av innenlandsk råolje og ikke av råolje med opprinnelse i Russland, med mindre Direktoratet for eksportkontroll og sanksjoner har rimelig grunn til å anta at de er framstilt av russisk råolje.

Det er forbudt direkte eller indirekte å yte faglig bistand, formidlingstjenester, finansiering eller finansiell bistand samt forsikring og gjenforsikring knyttet til forbudet i første ledd.

I § 17k gjøres følgende endringer:

Femte ledd skal lyde:
