§ Art 8. Right to respect for private and family life
Right to respect for private and family life
1. Everyone has the right to respect for his private and family life, his home and his correspondence.
2. There shall be no interference by a public authority with the exercise of this right except such as is in accordance with the law and is necessary in a democratic society in the interests of national security, public safety or the economic well-being of the country, for the prevention of disorder or crime, for the protection of health or morals, or for the protection of the rights and freedoms of others.
1. This Protocol shall enter into force on the first day of the month following the date on which five member States of the Council of Europe have expressed their consent to be bound by the Protocol in accordance with the provisions of Article 7.
2. In respect of any member State which subsequently expresses its consent to be bound by it, the Protocol shall enter into force on the first day of the month following the date of the deposit of the instrument of ratification, acceptance or approval.
This Protocol shall be open for signature by member States of the Council of Europe which have signed the Convention. It is subject to ratification, acceptance or approval. A member State of the Council of Europe may not ratify, accept or approve this Protocol without previously or simultaneously ratifying the Convention. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.
The Secretary General of the Council of Europe shall notify all the member States of the Council of Europe of:
a) any signature;
b) the deposit of any instrument of ratification, acceptance or approval;
c) any date of entry into force of this Protocol in accordance with Articles 4 and 7;
d) any other act, notification or communication relating to this Protocol.
In witness whereof the undersigned, being duly authorised thereto, have signed this Protocol.
Done at Vilnius, this 3 May 2002, in English and in French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each member State of the Council of Europe.
1. Enhver har rett til respekt for sitt privatliv og familieliv, sitt hjem og sin korrespondanse.
2. Det skal ikke skje noe inngrep av offentlig myndighet i utøvelsen av denne rettighet unntatt når dette er i samsvar med loven og er nødvendig i et demokratisk samfunn av hensyn til den nasjonale sikkerhet, offentlige trygghet eller landets økonomiske velferd, for å forebygge uorden eller kriminalitet, for å beskytte helse eller moral, eller for å beskytte andres rettigheter og friheter.
1. Denne protokoll skal tre i kraft den første dag i den måned som følger etter den dag da fem av medlemsstatene i Europarådet har gitt sitt samtykke til å være bundet av Protokollen i samsvar med bestemmelsene i artikkel 7.
2. For en medlemsstat som senere gir sitt samtykke til å være bundet av Protokollen, skal den tre i kraft den første dag i måneden etter den dag vedkommende stats ratifikasjons-, vedtakelses- eller godkjenningsdokument er blitt deponert.
Denne protokoll skal være åpen for undertegning av medlemsstater av Europarådet som har undertegnet Konvensjonen. Den kan bli ratifisert, vedtatt eller godkjent. En medlemsstat i Europarådet kan ikke ratifisere, vedta eller godkjenne denne Protokoll uten tidligere eller samtidig å ha ratifisert Konvensjonen. Ratifikasjons-, vedtakelses- eller godkjenningsdokumenter skal bli deponert hos Generalsekretæren i Europarådet.
Europarådets generalsekretær skal underrette alle medlemsstatene i Europarådet om:
a) enhver undertegning;
b) deponering av ethvert ratifikasjons-, godtakelses- eller godkjenningsdokument;
c) enhver dato da denne protokoll trer i kraft i samsvar med artiklene 4 og 7;
d) enhver annen handling, meddelelse eller erklæring som gjelder denne protokoll.
Som bekreftelse på dette har de undertegnede, som har fått behørig fullmakt til det, undertegnet denne protokoll.
Utferdiget i Vilnius 3. mai 2002, i ett eksemplar på engelsk og fransk tekst, som begge har samme gyldighet og som skal bli deponert i Europarådets arkiver. Generalsekretæren i Europarådet skal oversende bekreftede kopier til hver medlemsstat i Europarådet.
1. The States Parties to the present Covenant undertake to ensure:
a) the right of everyone to form trade unions and join the trade union of his choice, subject only to the rules of the organization concerned, for the promotion and protection of his economic and social interests. No restrictions may be placed on the exercise of this right other than those prescribed by law and which are necessary in a democratic society in the interests of national security or public order or for the protection of the rights and freedoms of others;
b) the right of trade unions to establish national federations or confederations and the right of the latter to form or join international trade-union organizations;
c) the right of trade unions to function freely subject to no limitations other than those prescribed by law and which are necessary in a democratic society in the interests of national security or public order or for the protection of the rights and freedoms of others;
d) the right to strike, provided that it is exercised in conformity with the laws of the particular country.
2. This Article shall not prevent the imposition of lawful restrictions on the exercise of these rights by members of the armed forces or of the police or of the administration of the State.
3. Nothing in this Article shall authorize States Parties to the International Labour Organisation Convention of 1948 concerning Freedom of Association and Protection of the Right to Organize to take legislative measures which would prejudice, or apply the law in such a manner as would prejudice, the guarantees provided for in that Convention.
1. Konvensjonspartene forplikter seg til å sikre:
a) Rett for enhver til, for å fremme og beskytte sine interesser på det økonomiske og sosiale område, å danne fagforeninger og slutte seg til en fagforening etter eget valg bare avhengig av vedkommende forenings vedtekter. Utøvelsen av denne rett må ikke underkastes andre innskrenkninger enn dem som følger av lov, og som er nødvendige i et demokratisk samfunn av hensyn til den nasjonale sikkerhet eller den alminnelige samfunnsorden eller for å verne andres rettigheter og friheter,
b) Rett for fagforeninger til å danne nasjonale forbund eller gruppevise sammenslutninger og rett for disse til å danne eller slutte seg til internasjonale fagforeningsorganisasjoner,
c) Rett for fagforeninger til fritt å utøve sin virksomhet uten andre begrensninger enn dem som følger av lov, og som er nødvendige i et demokratisk samfunn av hensyn til den nasjonale sikkerhet eller den alminnelige samfunnsorden eller for å verne andres rettigheter og friheter,
d) Rett til å streike, forutsatt at streikeretten blir utøvet i samsvar med lovene i det enkelte land.
2. Denne artikkel skal ikke være til hinder for at det fastsettes lovlige innskrenkninger i utøvelsen av disse rettigheter for personer som tjenestegjør i de væpnede styrker, politiet eller statsforvaltningen.
3. Intet i denne artikkel skal gi stater som er parter i Den internasjonale arbeidsorganisasjonens konvensjon av 1948 om foreningsfrihet og vern av organisasjonsretten, adgang til å treffe lovgivningstiltak, eller anvende loven på en måte som innebærer inngrep i de garantier som er fastsatt i nevnte konvensjon.
1. No one shall be held in slavery; slavery and the slave-trade in all their forms shall be prohibited.
2. No one shall be held in servitude.

a) No one shall be required to perform forced or compulsory labour;
b) Paragraph 3.a shall not be held to preclude, in countries where imprisonment with hard labour may be imposed as a punishment for a crime, the performance of hard labour in pursuance of a sentence to such punishment by a competent court;
c) For the purpose of this paragraph the term «forced or compulsory labour» shall not include: i) any work or service, not referred to in subparagraph b, normally required of a person who is under detention in consequence of a lawful order of a court, or of a person during conditional release from such detention; ii) any service of a military character and, in countries where conscientious objection is recognized, any national service required by law of conscientious objectors; iii) any service exacted in cases of emergency or calamity threatening the life or well-being of the community; iv) any work or service which forms part of normal civil obligations.
1. The present Protocol is open for signature by any State which has signed the Covenant.
2. The present Protocol is subject to ratification by any State which has ratified or acceded to the Covenant. Instruments of ratification shall be deposited with the Secretary General of the United Nations.
3. The present Protocol shall be open to accession by any State which has ratified or acceded to the Covenant.
4. Accession shall be effected by the deposit of an instrument of accession with the Secretary General of the United Nations.
5. The Secretary General of the United Nations shall inform all States which have signed the present Protocol or acceded to it of the deposit of each instrument of ratification or accession.
1. The present Protocol shall enter into force three months after the date of the deposit with the Secretary General of the United Nations of the tenth instrument of ratification or accession.
2. For each State ratifying the present Protocol or acceding to it after the deposit of the tenth instrument of ratification or accession, the present Protocol shall enter into force three months after the date of the deposit of its own instrument of ratification or accession.
1. Ingen må holdes i slaveri; slaveri og slavehandel i enhver form skal være forbudt.
2. Ingen må holdes i trelldom.

a) Ingen må pålegges å utføre tvangsarbeid eller annet påtvunget arbeid.
b) I land hvor frihetsberøvelse med straffarbeid kan idømmes som straff for en forbrytelse skal bestemmelsen i punkt a ikke være til hinder for å la noen utføre straffarbeid i samsvar med en dom på tvangsarbeid som er avsagt av en kompetent domstol.
c) Uttrykket «tvangsarbeid eller annet påtvunget arbeid» i denne bestemmelse omfatter ikke: i) Arbeid eller tjeneste, som ikke er nevnt under punkt b og som normalt kreves av den som er berøvet friheten i henhold til en lovlig beslutning truffet av en domstol, eller av den som er betinget løslatt fra slik frihetsberøvelse. ii) Tjeneste av militær karakter og, i land som anerkjenner militærnekting av samvittighetsgrunner, annen samfunnstjeneste som i medhold av lov kreves av den som nekter militærtjeneste av samvittighetsgrunner. iii) Tjeneste som kreves når nødstilstand eller ulykker truer samfunnets liv eller velferd. iv) Arbeid eller tjeneste som inngår i vanlige borgerplikter.
1. Denne protokoll er åpen for undertegning av enhver stat som har undertegnet konvensjonen.
2. Denne protokoll kan ratifiseres av enhver stat som har ratifisert eller tiltrådt konvensjonen. Ratifikasjonsdokumentene skal deponeres hos De forente nasjoners generalsekretær.
3. Denne protokoll er åpen for tiltredelse av enhver stat som har ratifisert eller tiltrådt konvensjonen.
4. Tiltredelse skjer ved deponering av tiltredelsesdokument hos De forente nasjoners generalsekretær.
5. De forente nasjoners generalsekretær skal underrette alle stater som har undertegnet eller tiltrådt denne protokoll om deponeringen av ethvert ratifikasjons- eller tiltredelsesdokument.
1. Denne protokoll skal tre i kraft tre måneder etter datoen for deponering av det tiende ratifikasjons- eller tiltredelsesdokument hos De forente nasjoners generalsekretær.
2. For hver stat som ratifiserer eller tiltrer denne protokoll etter deponeringen av det tiende ratifikasjons- eller tiltredelsesdokument, skal denne protokoll tre i kraft tre måneder etter datoen for deponering av dens eget ratifikasjons- eller tiltredelsesdokument.
1. States Parties undertake to respect the right of the child to preserve his or her identity, including nationality, name and family relations as recognized by law without unlawful interference.
2. Where a child is illegally deprived of some or all of the elements of his or her identity, States Parties shall provide appropriate assistance and protection, with a view to speedily re-establishing his or her identity.
1. Each State Party shall submit, within two years following the entry into force of the Protocol for that State Party, a report to the Committee on the Rights of the Child providing comprehensive information on the measures it has taken to implement the provisions of the Protocol, including the measures taken to implement the provisions on participation and recruitment.
2. Following the submission of the comprehensive report, each State Party shall include in the reports they submit to the Committee on the Rights of the Child, in accordance with article 44 of the Convention, any further information with respect to the implementation of the Protocol. Other States Parties to the Protocol shall submit a report every five years.
3. The Committee on the Rights of the Child may request from States Parties further information relevant to the implementation of this Protocol.
1. States Parties shall adopt appropriate measures to protect the rights and interests of child victims of the practices prohibited under the present Protocol at all stages of the criminal justice process, in particular by:
a) Recognizing the vulnerability of child victims and adapting procedures to recognize their special needs, including their special needs as witnesses;
b) Informing child victims of their rights, their role and the scope, timing and progress of the proceedings and of the disposition of their cases;
c) Allowing the views, needs and concerns of child victims to be presented and considered in proceedings where their personal interests are affected, in a manner consistent with the procedural rules of national law;
d) Providing appropriate support services to child victims throughout the legal process;
e) Protecting, as appropriate, the privacy and identity of child victims and taking measures in accordance with national law to avoid the inappropriate dissemination of information that could lead to the identification of child victims;
f) Providing, in appropriate cases, for the safety of child victims, as well as that of their families and witnesses on their behalf, from intimidation and retaliation;
g) Avoiding unnecessary delay in the disposition of cases and the execution of orders or decrees granting compensation to child victims.
2. States Parties shall ensure that uncertainty as to the actual age of the victim shall not prevent the initiation of criminal investigations, including investigations aimed at establishing the age of the victim.
3. States Parties shall ensure that, in the treatment by the criminal justice system of children who are victims of the offences described in the present Protocol, the best interest of the child shall be a primary consideration.
4. States Parties shall take measures to ensure appropriate training, in particular legal and psychological training, for the persons who work with victims of the offences prohibited under the present Protocol.
5. States Parties shall, in appropriate cases, adopt measures in order to protect the safety and integrity of those persons and/or organizations involved in the prevention and/or protection and rehabilitation of victims of such offences.
6. Nothing in the present article shall be construed as prejudicial to or inconsistent with the rights of the accused to a fair and impartial trial.
1. Partene forplikter seg til å respektere barnets rett til å bevare sin identitet, herunder statsborgerskap, navn og familieforhold som anerkjent av loven, uten ulovlig innblanding.
2. Dersom et barn ulovlig blir fratatt sin identitet helt eller delvis, skal partene yte egnet bistand og beskyttelse med henblikk på hurtig gjenoppretting av hans eller hennes identitet.
1. Innen to år etter at protokollen er trådt i kraft for en part skal parten oversende en rapport til Komiteen for barnets rettigheter med fullstendig informasjon om de tiltak som er truffet for å gjennomføre protokollens bestemmelser, herunder tiltak truffet for å gjennomføre bestemmelsene om deltakelse og rekruttering.
2. Etter at denne fullstendige rapporten er lagt fram, skal hver part inkludere i rapporter som de forelegger for Komiteen for barnets rettigheter i samsvar med artikkel 44 i konvensjonen, enhver ny opplysning om gjennomføringen av protokollen. Andre protokollparter skal legge fram rapport hvert femte år.
3. Komiteen for barnets rettigheter kan be partene om ytterligere opplysninger som er relevante for gjennomføringen av denne protokoll.
Partene skal treffe egnede tiltak for å verne om rettighetene og interessene til barn som er offer for handlinger som er forbudt etter denne protokoll, på alle trinn i den strafferettslige prosessen, særlig ved å:
a) erkjenne de berørte barnas sårbarhet og tilrettelegge saksbehandlingen slik at deres særlige behov blir ivaretatt, herunder deres særlige behov som vitne,
b) informere de berørte barna om deres rettigheter, deres rolle og om saksgangens omfang, beramming og fremdrift samt om avgjørelse i deres sak.
c) tillate at de berørte barnas synspunkter, behov og bekymringer blir lagt fram og vurdert under saksgangen dersom deres personlige interesser er berørt, på en måte som er forenlig med prosessreglene i nasjonal rett,
d) tilby de berørte barna hensiktsmessige støttetjenester gjennom hele den strafferettslige prosessen,
e) beskytte, der det er hensiktsmessig, de berørte barnas privatliv og identitet, samt treffe tiltak i samsvar med nasjonal rett for å unngå utilbørlig spredning av informasjon som vil kunne føre til at barna blir identifisert,
f) ved behov sørge for at berørte barn, samt deres familie og vitner i deres favør, skjermes mot trusler eller hevnaksjoner,
g) unngå unødige forsinkelser når det gjelder å treffe avgjørelse i saker, og når det gjelder fullbyrdelsen av kjennelse eller vedtak som gir erstatning til barn som er offer for slike handlinger.
2. Partene skal sikre at usikkerhet om offerets faktiske alder ikke skal hindre at det innledes etterforskning, herunder etterforskning for å fastslå offerets alder.
3. Partene skal sikre at barnets beste skal være et grunnleggende hensyn under rettssystemets behandling av barn som er offer for de straffbare handlinger som er beskrevet i denne protokoll.
4. Partene skal treffe tiltak for å sørge for egnet opplæring, særlig opplæring i juss og psykologi, for personer som arbeider med barn som er offer for de straffbare handlinger som er forbudt etter denne protokoll.
5. Statene skal, når det er hensiktsmessig, treffe tiltak for å beskytte sikkerheten og integriteten til de personer og/eller organisasjoner som driver med forebygging og/eller vern og rehabilitering av barn som har vært offer for slike straffbare handlinger.
6. Ikke noe i denne artikkel skal tolkes slik at det er til skade for eller uforenlig med den tiltaltes rett til en rettferdig og upartisk rettssak.
States Parties shall take all appropriate measures to ensure to women, on equal terms with men and without any discrimination, the opportunity to represent their Governments at the international level and to participate in the work of international organizations.
1. If the Committee receives reliable information indicating grave or systematic violations by a State Party of rights set forth in the Convention, the Committee shall invite that State Party to cooperate in the examination of the information and to this end to submit observations with regard to the information concerned.
2. Taking into account any observations that may have been submitted by the State Party concerned as well as any other reliable information available to it, the Committee may designate one or more of its members to conduct an inquiry and to report urgently to the Committee. Where warranted and with the consent of the State Party, the inquiry may include a visit to its territory.
3. After examining the findings of such an inquiry, the Committee shall transmit these findings to the State Party concerned together with any comments and recommendations.
4. The State Party concerned shall, within six months of receiving the findings, comments and recommendations transmitted by the Committee, submit its observations to the Committee.
5. Such an inquiry shall be conducted confidentially and the cooperation of the State Party shall be sought at all stages of the proceedings.
Konvensjonspartene skal treffe alle tiltak som er nødvendige for å sikre kvinner muligheten til å representere sine regjeringer på internasjonalt nivå og delta i arbeidet i internasjonale organisasjoner, på lik linje med menn og uten noen diskriminering.
1. Dersom komiteen mottar pålitelig informasjon som indikerer at en statspart alvorlig eller systematisk krenker rettighetene omhandlet i Konvensjonen, skal komiteen anmode statsparten om å samarbeide i granskningen av informasjonen og i den hensikt avgi sine merknader til denne informasjonen.
2. Etter å ha tatt hensyn til eventuelle merknader som kan være avgitt av vedkommende statspart samt enhver annen pålitelig opplysning som den har, kan komiteen utpeke ett eller flere av sine medlemmer til å foreta en undersøkelse og raskt rapportere tilbake til komiteen. Der det er nødvendig, og med statspartens samtykke, kan undersøkelsen omfatte et besøk på dens territorium.
3. Etter å ha gransket resultatene av en slik undersøkelse, skal komiteen oversende disse resultatene til vedkommende statspart sammen med eventuelle kommentarer og anbefalinger.
4. Innen seks måneder etter å ha mottatt resultatene, kommentarene og anbefalingene oversendt fra komiteen, skal vedkommende statspart legge fram sine merknader for komiteen.
5. En slik undersøkelse skal foretas konfidensielt og statspartens samarbeid skal søkes på alle trinn i prosessen.
